Section § 34580

Explanation

This section establishes that the Madera Water District, originally created under a specific 1987 law, will continue to exist as a district under the current set of laws.

The Madera Water District created pursuant to the Madera Water District Act (Chapter 735 of the Statutes of 1987) is hereby continued as a district under this division.

Section § 34581

Explanation

This law explains how the initial board of directors for the Madera Water District is established. The first board is appointed by the Madera County Board of Supervisors. The current directors serving as of December 31, 1992, will continue until the new board is appointed. Once appointed, this first board will remain in place until new directors either elected or appointed take over.

(a)CA Water Code § 34581(a) The first board of directors of the Madera Water District, as a district under this division, shall be appointed by the Board of Supervisors of the County of Madera.
(b)CA Water Code § 34581(b) The board of directors of the Madera Water District, as a district created pursuant to the Madera Water District Act (Chapter 735 of the Statutes of 1987) serving on December 31, 1992, shall continue to serve on and after January 1, 1993, until the first board of directors of the Madera Water District, as a district under this division, is appointed pursuant to subdivision (a).
(c)CA Water Code § 34581(c) The first board of directors of the Madera Water District, as a district under this division, that is appointed pursuant to subdivision (a) shall hold office until their successors are elected or appointed and qualified.

Section § 34582

Explanation

The Madera Water District set up elections to choose new directors to replace the first group of directors. Three directors, chosen randomly, had their successors elected on November 2, 1993. The remaining two directors had their successors elected on November 7, 1995.

The successors to three of the first directors of the Madera Water District, as a district under this division, chosen by lot, shall be elected at the general district election held on November 2, 1993, and the successors to the remaining two directors shall be elected at the general district election held on November 7, 1995.

Section § 34583

Explanation

This section states that the Madera Water District, as established under this division, takes over all previous actions, rights, and obligations of the original Madera Water District, which was created by a specific law in 1987.

The Madera Water District, as a district under this division, succeeds to actions taken, rights acquired, and obligations undertaken by the Madera Water District created pursuant to the Madera Water District Act (Chapter 735 of the Statutes of 1987).
