Section § 31540

Explanation

This law requires the transportation department to create and enforce safety rules for carrying certain types of containers on trucks or trailers.

These include containers like freight vans or tank containers that can be removed from their vehicle frames, and collapsible containers used for liquids.

It is illegal not to follow the rules set by the department regarding these types of transportation methods.

(a)CA Vehicle Code § 31540(a) The department shall adopt and enforce such regulations as it determines are necessary for public safety regarding the transportation of:
(1)CA Vehicle Code § 31540(a)(1) Freight van or tank containers which can be removed from the running gear or chassis of a truck or trailer, and
(2)CA Vehicle Code § 31540(a)(2) Collapsible containers used to transport liquids on flatbed vehicles.
(b)CA Vehicle Code § 31540(b) It is unlawful to fail to comply with any provision of the regulations adopted by the department.
