Section § 19995

Explanation

This law explains that if someone disagrees with a building standard related to factory-built housing, they can appeal to the department, but they should first submit the appeal to a local enforcement agency if one is in charge. However, the department won't handle appeals about local rules concerning the installation of factory-built housing.

Except as provided in Section 18945, the department shall hear appeals brought by any person regarding the application to such person of any building standard published in the State Building Standards Code relating to factory-built housing or to any other rule or regulation of the department promulgated pursuant to this part. Any such appeals shall first be submitted to the local enforcement agency, if any, delegated by the department to enforce the provisions of this part. The department shall not hear any appeal regarding any local ordinance, rule, or regulation related to the installation of factory-built housing.

Section § 19996

Explanation

The department is allowed to create informal rules for handling appeal hearings according to this chapter.

The department may promulgate informal hearing rules pertaining to the hearing of appeals under the provisions of this chapter.
