The State Fire Marshal shall seize any flamethrowing device in the possession of any person who does not have a valid flamethrowing device permit issued pursuant to this part.

If someone has a flamethrower without the proper permit, the State Fire Marshal can take it away. Basically, you need a valid permit to legally have a flamethrower, or it'll be seized.

Section § 12761
If you use or have a flamethrower without the right permit, you're committing a crime. If you're caught, you could face up to a year in county jail, or time in state prison, or a fine up to $10,000, or even both jail time and a fine.
Any person who uses or possesses any flamethrowing device without a valid flamethrowing device permit issued pursuant to this part is guilty of a public offense and, upon conviction, shall be punished by imprisonment in the county jail for a term not to exceed one year, or in the state prison, or by a fine not to exceed ten thousand dollars ($10,000), or by both imprisonment and fine.
