Section § 9600

Explanation

This law states that a mausoleum or columbarium can only be constructed or modified if the entire building meets specific minimum standards. These standards apply to both new buildings and any changes made to existing ones.

Even if a part of the building is used for something else, the whole structure must comply with these requirements. Any additions or changes to existing mausoleums or columbariums must also meet these standards.

No mausoleum or columbarium shall be constructed and no existing building or structure shall be altered for use as a mausoleum or columbarium unless the entire building or structure, including any portion to be used for any other purpose, is in conformity with the minimum requirements set forth in this chapter. Any addition to or alteration of any existing mausoleum or columbarium shall conform to the minimum requirements set forth in this chapter.

Section § 9600.5

Explanation

This law section allows the Cemetery and Funeral Bureau to create rules for building private mausoleums or columbariums. The Cemetery and Funeral Bureau may, in addition to the construction methods and standards allowed in this chapter, adopt regulations for the construction of private mausoleums or private columbariums, which at a minimum, include the following:
(a)CA Health & Safety Code § 9600.5(a)  Standards for design and construction for seismic load protection.
(b)CA Health & Safety Code § 9600.5(b)  Methods of construction, including solid granite construction.
(c)CA Health & Safety Code § 9600.5(c)  Methods of sealing to prevent leakage from crypts.
(d)CA Health & Safety Code § 9600.5(d)  Ventilation of crypts.
