Section § 38902
This law allows a city to charge a fee for sewer services based on property area, frontage, or parcel, even if the service isn't used. The city must follow specific procedures for notice and hearings to set or adjust this fee, and can continue the same rate annually without changes. If new or increased fees are proposed, the same notice procedures apply. The fee can vary by land use or service availability and might only apply to certain city zones. The city can bill these fees separately or include them in the annual county tax bill, making them a lien if unpaid. Late payments can incur penalties similar to other county taxes and must be noted separately on tax bills, if possible.
