Section § 11791

Explanation

This law makes it illegal for people who are governed by this division to engage in several unfair or dishonest activities. Such activities include making false claims, applying ineffective or improper materials, and engaging in other unfair practices. It's also illegal to operate carelessly or negligently. Additionally, one must comply with all related regulations and orders and keep accurate records and reports as required.

It is unlawful for any person subject to this division to do any of the following:
(a)CA Food And Agriculture Code § 11791(a) Make any false or fraudulent claim, or misrepresent the effects of material or method to be applied, apply any worthless or improper material, or otherwise engage in any unfair practices.
(b)CA Food And Agriculture Code § 11791(b) Operate in a faulty, careless, or negligent manner.
(c)CA Food And Agriculture Code § 11791(c) Refuse or neglect to comply with this division, or any regulation issued pursuant to this division, or any lawful order of the commissioner or the director.
(d)CA Food And Agriculture Code § 11791(d) Refuse or neglect to keep and maintain the records which are required by this division, or to make reports when and as required.

Section § 11792

Explanation

This law makes it illegal for businesses or individuals covered under this law to engage in several dishonest or improper actions. It prohibits making false records or reports, operating in a location without proper registration, using unqualified personnel to operate equipment, and falsifying or misrepresenting information related to licensing requirements. Additionally, it bans cheating on licensing exams, including unauthorized copying or sharing of exam materials. Finally, it requires compliance with specific legal provisions in Chapter 3 of Division 7.

It is also unlawful for any person that is subject to this division to do any of the following:
(a)CA Food And Agriculture Code § 11792(a) Make any false or fraudulent record or report.
(b)CA Food And Agriculture Code § 11792(b) Operate in any county without first having registered with the commissioner.
(c)CA Food And Agriculture Code § 11792(c) Operate equipment with incompetent or unqualified persons in charge of the equipment.
(d)CA Food And Agriculture Code § 11792(d) Make any false or fraudulent statement, record, or report or use any fraud or misrepresentation in connection with meeting any license requirement found in this division.
(e)CA Food And Agriculture Code § 11792(e) Cheat on or subvert a licensing examination. As used in this subdivision, “subvert” includes, but is not limited to, the unauthorized possession, reproduction, or distribution of any portion of the licensing examination.
(f)CA Food And Agriculture Code § 11792(f) Fail to comply with the provisions of Chapter 3 (commencing with Section 14001) of Division 7.
