Section § 11531

Explanation

This section of the law states that certain activities are exempt from the requirements of this division, unless otherwise specified in a different chapter. The activities exempted include structural pest control operations that need a license, treating fabrics or structural materials with preservatives, sanitation services for handling waste and sewage, seed treatments that are a side part of someone's main business, capturing and removing pests like raccoons or mice without pesticides, and pool cleaning, provided no restricted materials are involved. However, people must still comply with the California Endangered Species Act.

Except as provided in Chapter 6 (commencing with Section 12001), this division does not apply to any person while engaged in any of the following:
(a)CA Food And Agriculture Code § 11531(a) An activity that is defined as structural pest control and required to be licensed under Chapter 14 (commencing with Section 8500) of Division 3 of the Business and Professions Code.
(b)CA Food And Agriculture Code § 11531(b) Preservative treatment of fabrics or structural materials.
(c)CA Food And Agriculture Code § 11531(c) Sanitation services for collection, disposal, and treatment of wastewater, refuse, or sewage.
(d)CA Food And Agriculture Code § 11531(d) Seed treatment that is incidental to the person’s regular business.
(e)CA Food And Agriculture Code § 11531(e) Live capture and removal or exclusion of vertebrate pests, bees, or wasps without the use of pesticides. Vertebrate pests include, but are not limited to, bats, raccoons, skunks, squirrels, mice, rats, and pigeons. This section does not exempt a person from the California Endangered Species Act (Chapter 1.5 (commencing with Section 2050) of Division 3 of the Fish and Game Code).
(f)CA Food And Agriculture Code § 11531(f) Pool cleaning services, unless the person is selling, applying, using, or distributing a restricted material.
