Section § 20015

Explanation

This law applies to franchises if the person who owns the franchise is based in California, or if the business itself is or was run in California. Also, if a franchise agreement tries to make the owner give up their rights under this law, that part of the agreement is considered unfair and will not be enforced.

(a)CA Business & Professions Code § 20015(a) The provisions of this chapter apply to any franchise when either the franchisee is domiciled in this state or the franchised business is or has been operated in this state.
(b)CA Business & Professions Code § 20015(b) Any provision of a franchise agreement requiring the franchisee to waive the provisions of this chapter shall be deemed contrary to public policy and shall be void and unenforceable.
