Section § 4991

Explanation

This section establishes the official name for this group of laws as the Clinical Social Worker Practice Act and emphasizes that it should be interpreted broadly to achieve its purposes.

This chapter shall be known, and may be cited, as the Clinical Social Worker Practice Act. It shall be liberally construed to effect its objectives.

Section § 4991.1

Explanation

This law says that if someone claims they can do clinical social work or actually does it in exchange for any type of payment, even donations, they are considered as practicing clinical social work.

A person engages in the practice of clinical social work when he or she performs or offers to perform or holds himself or herself out as able to perform this service for remuneration in any form, including donations.

Section § 4991.2

Explanation

This section explains two specific terms used in this chapter. An 'accredited school of social work' is one that's been officially recognized by a specific accrediting body for social work education. Also, when you see 'Board,' it means the Board of Behavioral Sciences.

For purposes of this chapter:
(a)CA Business & Professions Code § 4991.2(a) “Accredited school of social work” means a school that is accredited by the Commission on Accreditation of the Council on Social Work Education.
(b)CA Business & Professions Code § 4991.2(b) “Board” means the Board of Behavioral Sciences.
