Section § 75640

Explanation

If you don't register your water-producing facility as required by the specified chapter, you're committing a misdemeanor, which is a criminal offense.

Any person who fails to register a water-producing facility, as required by Chapter 2 (commencing with Section 75540) of this part, is guilty of a misdemeanor.

Section § 75641

Explanation

This law section makes it a crime (misdemeanor) for anyone to produce water from a facility that should be registered but isn't. To avoid being guilty, the facility must be registered within the time set by another section of the code, and if needed, it should have a water-measuring device to track water usage. Breaking this law just once can lead to separate charges for each day the violation continues.

Any person who produces water from any water-producing facility required to be registered pursuant to Chapter 2 (commencing with Section 75540) of this part is guilty of a misdemeanor unless such facility has been registered with the district within the time required by Chapter 2 and, if required by the board, has a water-measuring device affixed thereto capable of registering the accumulated amount of water produced therefrom.
Each day of operation in violation of this section shall constitute a separate offense.

Section § 75642

Explanation

This law makes it illegal to tamper with water-measuring devices on water-producing facilities. If someone alters or interferes with these devices to make them show incorrect water usage, or submits a false water production report to dodge regulations, they can be charged with a misdemeanor.

Any person who injures, alters, removes, resets, adjusts, manipulates, obstructs, or in any manner interferes or tampers with, or procures or causes or directs any person to injure, alter, remove, reset, adjust, manipulate, obstruct, or in any manner interfere or tamper with, any water-measuring device affixed to any water-producing facility as required by Chapter 2 (commencing with Section 75540) of this part, so as to cause such device to improperly or inaccurately measure and record the water production, or any person who, with intent to evade any provision or requirement of this part, files with the district any false or fraudulent water production statement, is guilty of a misdemeanor.
