Section § 74030

Explanation

This law section explains that a district can be formed by a county's board of supervisors in California. The conditions for forming a district are outlined in this specific part of the legal code. Once established, the district can use any powers explicitly given to it or those that are implied as necessary.

A district may be organized and established by the board of supervisors of any county in this state, as expressly provided in this part, when the conditions stated in this part are found to exist, and may exercise the powers expressly granted in this division, or necessarily implied.

Section § 74031

Explanation

This section allows for the creation of a water district when local voters petition for it. The district can cover an area that includes all or part of one or more watersheds of streams or unnavigable rivers. It can also include areas nearby or those that rely on water from these streams, rivers, or underground sources. The goal is to conserve water from these sources.

A district may be organized upon petition by the qualified electors in an area comprising the whole or a part or parts of one or more watersheds of any stream or streams of water or unnavigable river or rivers, or territory adjacent to such watershed or watersheds, or deriving such area’s water supply, in whole or in part, from such stream or streams, or river or rivers, or the subterranean supply of waters therefrom, for the conservation of the waters of such stream or streams or unnavigable river or rivers.

Section § 74032

Explanation

This law states that a district can exist solely within unincorporated areas, or it can span both unincorporated and incorporated areas, and it can be located in one or several counties.

A district may be entirely within unincorporated territory or partly within unincorporated and partly within incorporated territory, and may be within one or more counties.

Section § 74033

Explanation

This law section states that a district's territory doesn't have to be connected or touching in all areas.

The territory to be included within a district need not be contiguous.
