Section § 74120

Explanation

If more than half of the votes in an election support creating a water conservation district, the board of supervisors will officially establish the district and recognize it by the chosen name. They will also declare the individuals with the most votes as directors of the new district.

If a majority of all the votes cast at the formation election are “Water conservation district—Yes,” the board of supervisors shall by an order entered in its minutes declare the territory duly formed as a water conservation district, under the designated name, and shall declare the persons receiving, respectively, the highest number of votes for director to be duly elected to such offices.

Section § 74121

Explanation

This law requires that once a new district is formed, the board of supervisors must immediately file the order, certified by their clerk, with the county recorder's office in each county where the district's land lies. They must also send a copy to the clerk of the board of supervisors in those counties. This filing marks the official completion of the district's formation.

The board of supervisors shall immediately cause a copy of the order declaring the district formed, duly certified by the clerk of the board, to be filed for record in the office of the county recorder of any county in which any portion of the lands embraced in the district is situated, and shall also immediately forward a copy thereof to the clerk of the board of supervisors of each of such counties. From and after such filing, the formation of the district is complete.

Section § 74122

Explanation

When a district is formed, the clerk of the board of supervisors must quickly send a certificate to the Secretary of State. This certificate needs to include the district's name, formation date, and where it's located. It also needs to describe or map out its boundaries. If the order declaring the district's formation already includes this info, the clerk can just send that order instead of making a new certificate.

The clerk of the board of supervisors shall immediately file with the Secretary of State a certificate listing:
(a)CA Water Code § 74122(a) The name of the district.
(b)CA Water Code § 74122(b) The date of formation.
(c)CA Water Code § 74122(c) The county or counties in which the district is located, and a description of the boundaries of the district, or reference to a map showing such boundaries, which map shall be attached to the certificate, or reference to the county recorder’s office where a description of such boundaries has been recorded.
If the order declaring the district formed contains all of the information required to be in the certificate, the clerk of the board may file a copy of the order in lieu of the certificate.
