Section § 21120

Explanation

This law allows a board to merge multiple roles within their organization. Specifically, they can combine the jobs of assessor, collector, and treasurer. Additionally, they can merge positions like secretary, engineer, manager, assistant engineer, and assistant manager, with roles such as assessor, collector, or treasurer.

A board may consolidate any two or more of the offices of assessor, collector, and treasurer. The board may consolidate any two or more of the positions of secretary, engineer, manager, assistant engineer or assistant manager, and may combine any one or more of these positions with the offices of assessor, collector or treasurer.

Section § 21121

Explanation

This law requires that any consolidation order must be issued at least 120 days before a general election and will be effective during that election.

The order of consolidation shall be made at least 120 days prior to a general election and shall take effect at said election.

Section § 21122

Explanation

This law says that a board can separate different positions within a combined office at least 120 days before a general district election. Each separated position will then need to be filled during that election.

A board may at least 120 days before a general district election segregate consolidated offices, and each office so segregated shall be filled at said election.

Section § 21123

Explanation

This law allows a board to decide, at least 90 days before a general district election, whether the positions of assessor, collector, or treasurer should be filled by appointment instead of election. The board can appoint someone for these roles even if the person doesn't live in the district or vote there, and the appointed person serves at the board's discretion.

A board may, at least 90 days before a general district election, determine that the offices of assessor, collector, or treasurer or any of them shall be filled by appointment by the board to serve at its pleasure rather than being filled by election. A person so appointed need not be a resident or elector of the district.

Section § 21124

Explanation

This section allows a board to decide, at least 90 days before a general district election, that positions such as assessor, collector, or treasurer—if they are currently filled by appointment—should instead be filled by election at the next district election.

A board may, at least 90 days before a general district election, determine that the offices of assessor, collector, or treasurer or any of them that are currently appointive shall be filled by election at the next succeeding district election.
