Section § 21165

Explanation

This law states that the board is responsible for deciding how much officers are paid.

The board shall fix the compensation to be paid to all officers.

Section § 21166

Explanation

This law outlines the compensation and expense reimbursement for directors serving on certain boards. Generally, directors can earn up to $100 per day, but not more than six days a month. For districts that deal with electric power, directors have different payment options: up to $100 per day, a monthly salary of up to $600, or annual compensation capped at $15,000, which requires an ordinance. Specific rules apply for large districts over 500,000 acres.

Additionally, directors are entitled to have their actual and necessary expenses covered when working under board orders. The specifics of when activities are payable and how expenses are reimbursed are guided by defined sections of the Government Code.

Notwithstanding any other provision of law, a director, for sitting on the board or acting under its orders, shall receive both of the following:
(a)Copy CA Water Code § 21166(a)
(1)Copy CA Water Code § 21166(a)(1) Except as specified in paragraphs (2) and (3), compensation not to exceed one hundred dollars ($100) per day, not exceeding six days in any calendar month.
(2)CA Water Code § 21166(a)(2) In districts that produce or distribute electric power, one of the following methods of compensation:
(A)CA Water Code § 21166(a)(2)(A) Compensation not to exceed one hundred dollars ($100) per day.
(B)CA Water Code § 21166(a)(2)(B) A monthly salary of not to exceed six hundred dollars ($600) per month.
(C)CA Water Code § 21166(a)(2)(C) Annual compensation not to exceed fifteen thousand dollars ($15,000). Any annual compensation pursuant to this subparagraph shall be fixed by the adoption of an ordinance pursuant to Sections 20203 to 20207, inclusive.
(3)CA Water Code § 21166(a)(3) Districts containing 500,000 acres or more are governed by Section 22840.
(b)CA Water Code § 21166(b) Actual and necessary expenses when acting under the orders of the board.
For purposes of this section, the determination of whether a director’s activities on any specific day are compensable shall be made pursuant to Article 2.3 (commencing with Section 53232) of Chapter 2 of Part 1 of Division 2 of Title 5 of the Government Code. Reimbursement for these expenses is subject to Sections 53232.2 and 53232.3 of the Government Code.

Section § 21166.5

Explanation

This law allows directors to join in on group insurance and other benefit plans that are available to employees and officers. If they choose to participate, they must agree to have part of the premium deducted from their pay.

Notwithstanding the provisions of Section 21166, a director may participate in any plan for group insurance, group annuities, social security, medical and hospital service or any other authorized program which has been adopted and carried into effect for the benefit of all such officers and employees, including directors, as accept the same and authorize the board to make any necessary deductions from their compensation for payment of a portion of the premium thereon.
