Section § 20960

Explanation

If most people vote 'Irrigation District—Yes' in the formation election, the board of supervisors must officially establish the area as an irrigation district with the chosen name.

If upon the canvass of the formation election it appears that a majority of all the votes cast are “Irrigation District—Yes,” the board of supervisors shall by an order entered on its minutes declare the territory formed as a district under the name designated for it.

Section § 20961

Explanation

When a district is officially formed, the board of supervisors needs to quickly file a certified copy of this order with the county recorder's office in every county affected. They also must send a copy to the clerk of the board of supervisors in each affected county right away.

The board of supervisors shall immediately file for record in the office of the county recorder of each affected county a certified copy of the order declaring the district formed and shall also immediately forward a copy to the clerk of the board of supervisors of each affected county.

Section § 20962

Explanation

This law states that once an official order is filed that declares a district is formed, the creation of that district is officially complete.

Section § 20962.5

Explanation

When a new district is formed, the county clerk must quickly file a certificate with the Secretary of State. This certificate should include the name and formation date of the district, as well as details about which county or counties the district is in. It must also describe the district's boundaries or refer to a map or recorded document where these details are available. If the formation order already includes all this information, the clerk can just file that instead.

The county clerk of the principal county shall immediately file with the Secretary of State a certificate listing:
(a)CA Water Code § 20962.5(a) The name of the district.
(b)CA Water Code § 20962.5(b) The date of formation.
(c)CA Water Code § 20962.5(c) The county or counties in which the district is located, and a description of the boundaries of the district, or reference to a map showing such boundaries, which map shall be attached to the certificate, or reference to the county recorder’s office where a description of such boundaries has been recorded.
If the order declaring the district formed contains all of the information required to be in the certificate, the county clerk may file a copy of the order in lieu of the certificate.

Section § 20963

Explanation

This law states that once a district is established in a county, the county officials cannot form a new district that includes any land from the existing district unless they get permission from the board overseeing the current district.

The board of supervisors of any county in which any land embraced in a district is situated shall not after its formation allow another district to be formed including any portion of the same land without the consent of the board of the district in which the land is situated.
