Section § 25670

Explanation

This law explains that a district must raise funds by imposing a completion assessment if it needs to finish a planned project or purchase necessary property, water, or water rights. This situation arises if there's not enough money from sold bonds and no new bonds are approved, or if existing approved bonds can't be used for these purposes and no new bonds are approved.

A district shall by levy of a completion assessment provide for the completion of a plan of works adopted and the acquisition of necessary property, water, and water rights therefor when either:
(a)CA Water Code § 25670(a) The money raised by the sale of authorized bonds is insufficient and additional bonds are not voted for these purposes.
(b)CA Water Code § 25670(b) Bonds voted are unavailable for these purposes and additional bonds are not voted therefor.

Section § 25671

Explanation

An assessment to finish the project can't be charged unless two things happen: the board must first estimate the necessary funds, and then voters must approve a proposal to levy the assessment.

A completion assessment shall not be levied until both:
(a)CA Water Code § 25671(a) An estimate of the amount required to complete the plan has been made by the board.
(b)CA Water Code § 25671(b) A proposal for making the levy has been approved by the voters.

Section § 25672

Explanation

This section requires that before a proposal for a completion assessment is put to a vote, the board must officially record an order detailing certain essential information. This includes the amount of money to be raised, the purpose for which it is being raised, and the date of the election.

Before a completion assessment proposal is submitted to the voters, an order of submission shall be entered in the minutes of the board, stating:
(a)CA Water Code § 25672(a) The amount to be levied.
(b)CA Water Code § 25672(b) The purpose of the levy.
(c)CA Water Code § 25672(c) The day of the election.

Section § 25673

Explanation

This law section explains the requirements for notifying the public about an upcoming election. The notice must be posted in three public spots in each election area of the district for at least 20 days. Additionally, the notice needs to be published in a local newspaper once a week for at least three consecutive weeks.

Notice of the election shall be given by both:
(a)CA Water Code § 25673(a) Posting notices in three public places in each election precinct in the district for at least 20 days.
(b)CA Water Code § 25673(b) Publication in a newspaper published in the office county, once a week for at least three successive weeks.

Section § 25674

Explanation

This section requires that the notice for an upcoming election must include important details like the date, time, and locations of the voting places within each precinct. It also needs to state the amount of any proposed assessment that voters will be deciding on.

The notice of the election shall specify both:
(a)CA Water Code § 25674(a) The day, hours, and polling places in each precinct for holding the election.
(b)CA Water Code § 25674(b) The amount of assessment proposed to be levied.

Section § 25675

Explanation

This law states that during an election, the ballots must have the options 'Assessment—Yes' and 'Assessment—No', or similar wording, to indicate a choice regarding an assessment.

At the election the ballots shall contain the words “Assessment—Yes” and “Assessment—No” or equivalent words.

Section § 25676

Explanation

This law section explains that when an election is conducted, it should closely follow the same rules and procedures used in regular district elections to ensure consistency and fairness.

The election shall be held and the result determined and declared as nearly as practicable in conformity with the provisions governing general district elections.

Section § 25677

Explanation

This law section states that if more than half of the votes in an election are in favor of 'Assessment—Yes,' then the district's board must impose the assessment in the amount specified in the order.

If a majority of the votes cast at the election are “Assessment—Yes,” the district by its board shall levy an assessment in the amount stated in the order of submission.

Section § 25678

Explanation
If most people vote against the assessment in an election, this outcome is recorded officially.
If a majority of the votes cast are “Assessment—No,” the result of the election shall be entered of record.

Section § 25679

Explanation

This law section means that any minor mistakes or informalities during the process of an election won't make the election invalid, as long as the election was conducted fairly overall.

No informalities in the conduct of the election shall invalidate the election if fairly conducted.
