Section § 56030

Explanation

A county drainage district is led by a board of directors with at least five members. If the district doesn't include any cities, the county's board of supervisors serves as the board of directors. However, if it includes one or more cities, the board is composed of various officials including the leader of each city's governing body, the chair of the county board of supervisors, and additional appointees from both the cities and the county board of supervisors.

The governing body of a county drainage district is a board of directors of not less than five members.
If the district does not include a city or cities or any part thereof, the board of supervisors of the county is the board of directors of the district. If the district includes a city or cities or any part thereof, the members of the board of directors shall be as follows:
(a)CA Water Code § 56030(a) The presiding officer of the governing body of each city is a member of the board of directors;
(b)CA Water Code § 56030(b) The chairman of the board of supervisors is a member of the board of directors;
(c)CA Water Code § 56030(c) A member of the governing body of each city included within the district, other than the presiding officer, as appointed by the governing body of the city is a member of the board of directors;
(d)CA Water Code § 56030(d) Two members of the board of supervisors, other than the chairman of the board of supervisors, as appointed by the board of supervisors are members of the board of directors.

Section § 56031

Explanation

The district board can set a payment amount for its members attending meetings, but it can't be more than $10 per meeting. Members can only be paid for up to three meetings each month, plus they can be reimbursed for necessary travel expenses to the meeting location. This payment is separate from any other payments they might get for other official roles they hold. Whether a director's activities on a specific day can be paid is decided by another section of the government code, and any travel reimbursements must follow specific guidelines outlined in those codes.

The district board shall have power to fix the amount of compensation per meeting to be paid each member of the board for his or her services for each meeting attended by him or her; provided, that the compensation shall not exceed ten dollars ($10) for each meeting of the district board attended by him or her, together with expenses necessarily incurred by him or her in traveling between his or her place of residence and the place of meeting. However, no member shall receive compensation for attending more than three meetings of the board during any calendar month. This compensation shall be in addition to any other fees or compensation allowed by law for the other official positions specified in Section 56030 that are occupied by members of the district board. For purposes of this section, the determination of whether a director’s activities on any specific day are compensable shall be made pursuant to Article 2.3 (commencing with Section 53232) of Chapter 2 of Part 1 of Division 2 of Title 5 of the Government Code. Reimbursement for these expenses is subject to Sections 53232.2 and 53232.3 of the Government Code.
