Section § 31575

Explanation

This law says that improvement districts can be created within a district using the same process used in irrigation districts. Once established, these improvement districts will operate in the same way and have the same authority as those in irrigation districts.

Improvement districts may be formed in districts in the same manner as improvement districts are formed in irrigation districts. When formed, such improvement districts shall be governed in the same manner and shall have the same powers as improvement districts in irrigation districts.

Section § 31576

Explanation

The board of directors in a district has the same authority and duties as the board of directors in an irrigation district when it comes to creating and governing improvement districts.

The board of directors of a district shall have the same rights, powers, duties and responsibilities with respect to the formation and government of improvement districts in districts as the board of directors of an irrigation district has with respect to improvement districts in irrigation districts.

Section § 31577

Explanation

This law section explains that assessments, which are charges for improvements in a specific area, should be handled in almost the same way as annual taxes within the district. The only exception is that these assessments need to follow the procedures used for improvement districts in irrigation districts.

Assessments in an improvement district in a district shall be levied, collected and enforced at the same time and in as nearly the same manner as practicable as annual taxes for purposes of the district in which formed, except that the assessment shall be made in the same manner as provided with respect to improvement districts in irrigation districts.

Section § 31578

Explanation

This law applies to a specific area in the Kings County Water District, where an improvement district can be created to manage part of the Lakeside Ditch Company's system. If such a district is formed, the local voters can elect a five-member advisory board. This board makes recommendations on system operations and water distribution, which the district board must follow unless all its members agree otherwise. Initially, some advisory members serve two years, others four, then all serve four-year terms after.

If an improvement district is formed in the Kings County Water District to encompass all or a portion of the area within the district served by the Lakeside Ditch Company (a mutual water company) for the purpose of acquiring stock of such company, operating the system of such company, and furnishing the shareholders thereof with water, the voters in such improvement district may elect an advisory board of five members. The members of such advisory board first elected shall be elected at the election of district directors next held following the formation of the improvement district. The members of the advisory board shall be elected in the same manner as district directors. The members first elected shall at their first meeting classify themselves by lot so that three members shall hold office for two years and two members shall hold office for four years. Thereafter all members shall hold office for four years.
The advisory board in such improvement district may make recommendations to the district board solely as to matters pertaining to the operation of the system acquired from the Lakeside Ditch Company and the distribution of the water to which the shareholders of such company have rights. The district board shall follow any such recommendation unless it is rejected by the district board by unanimous vote of its members.

Section § 31579

Explanation

This section allows a district to perform all its responsibilities and utilize its authority for any improvement district it creates under this division.

All powers and duties of the district may be exercised on behalf of or within any improvement district formed pursuant to this division.
