Section § 12750

Explanation

This law allows California to adopt and authorize small flood control projects that are not directly approved by Congress. These projects are handled by the United States Corps of Engineers under a specific part of the 1948 Flood Control Act. The state's participation in funding these projects depends on recommendations from the Department of Water Resources and approval of estimated costs by the state legislature.

Small flood control projects not specifically authorized by Congress undertaken by the United States Corps of Engineers pursuant to Section 205 of the Flood Control Act of 1948 (Public Law 858, Eightieth Congress, Second Session, approved June 30, 1948), as amended, are hereby adopted and authorized at such estimated costs as may be appropriated for state cooperation by the Legislature upon the recommendation and advice of the Department of Water Resources.

Section § 12750.1

Explanation

This law states that the state will only pay for land and associated rights needed for small flood control projects if the benefits outweigh the costs. The department must also find that the project's plan is the most cost-effective when considering all expenses, including construction and maintenance.

The State shall pay the cost of lands, easements and rights-of-way for small flood control projects authorized by Section 12750 only if the department finds in its judgment that the benefits of the proposed works of improvement will exceed the costs thereof and that the project plan appears to be the most economical project plan, considering construction costs, lands, easements and rights-of-way costs, and costs of operation and maintenance.

Section § 12751

Explanation

This law section requires that any local government or public district affected by a small flood control project must provide assurances to the Secretary of the Army. These assurances are about cooperating locally with what's needed for such projects, as outlined in the amended Flood Control Act of 1948. The local agency will work with the Department of the Army to implement the project and can change plans if necessary to meet the goals of flood control.

Any county, city, state agency or public district affected by a small flood control project referred to in Section 12750 shall give assurances satisfactory to the Secretary of the Army that the local cooperation required for such projects by Section 205 of the Flood Control Act of 1948, as amended, will be furnished by such local agency. Such agency, in conjunction with the Department of the Army, shall execute the project and may make such modifications and amendments to the plans as may be necessary to execute them for the purposes of Chapters 1 and 2 of this part.
