Section § 34801

Explanation

Section § 34802

This law states that the board must have regular meetings, and the schedule for these meetings should be decided and agreed upon with a formal resolution.

The board shall hold regular meetings at such time and place as may be agreed upon by resolution.

Section § 34803

Section § 34804

Explanation

This law allows the Elsinore Water District's Board of Directors to hold their meetings either at the district office or at any publicly owned location within their jurisdiction, or up to one mile outside their jurisdiction, regardless of other laws that might suggest otherwise.

Notwithstanding Section 54954 of the Government Code, or any other provision of law, the Board of Directors of the Elsinore Water District may conduct its meetings at the district office, or at any publicly owned location that is within the boundaries, or not more than one mile outside the boundaries, of the territory over which the district exercises jurisdiction.

Section § 34805

Explanation

For the board to conduct official business, more than half of its members must be present.

A majority of the membership of the board shall constitute a quorum of the board for the transaction of business.

Section § 34806

Explanation

This law states that for any decision to be made during a directors' meeting, more than half of those present must agree, as long as enough members (a quorum) are there to hold the meeting.

The vote of a majority of the directors present at any meeting attended by a quorum is necessary to determine any proposition or resolution presented.

Section § 34807

Explanation

The board is responsible for running and overseeing all activities and business matters of the district, except in cases where specific exceptions are outlined.

The board, except as otherwise specifically provided, shall manage and conduct the business and affairs of the district.

Section § 34808

Explanation

This section requires that any district board that existed when this law was enacted must submit a certificate to the Secretary of State by January 1, 1964. This certificate must include the district's name, formation date, and counties in which the district is located, along with a map or detailed description of its boundaries. If all this information is already present in the district's formation order, a copy of that order can be submitted instead.

The board of a district in existence on the effective date of this section shall file a certificate with the Secretary of State on or before January 1, 1964, listing:
(a)CA Water Code § 34808(a) The name of the district.
(b)CA Water Code § 34808(b) The date of formation.
(c)CA Water Code § 34808(c) The county or counties in which the district is located, and a description of the boundaries of the district, or reference to a map showing such boundaries, which map shall be attached to the certificate, or reference to the county recorder’s office where a description of such boundaries has been recorded.
If the order declaring the district formed contains all of the information required to be in the certificate, the board may file a copy of the order in lieu of the certificate.
