Section § 79550

Explanation

This law section describes how $825 million is allocated for various projects under the CALFED Bay-Delta Program. Out of this, $50 million is designated for planning and feasibility studies related to surface water storage.

An additional $75 million is for specific water conveyance facilities, and $70 million is for Delta levee restoration. $180 million is set aside for improving water supply reliability, favoring long-term water purchase contracts. Another $180 million is allocated for ecosystem restoration, with a portion specifically for aiding farmers in this effort.

A sum of $90 million goes towards watershed program implementation. Finally, $180 million is dedicated to urban and agricultural water conservation and efficiency projects.

The sum of eight hundred twenty-five million dollars ($825,000,000) shall be available for appropriation by the Legislature from the fund for the balanced implementation of the CALFED Bay-Delta Program. Expenditures and grants pursuant to this chapter shall be limited to the following:
(a)CA Water Code § 79550(a) Fifty million dollars ($50,000,000) for surface water storage planning and feasibility studies.
(b)CA Water Code § 79550(b) Seventy-five million dollars ($75,000,000) for the water conveyance facilities described in subparagraph (B) of paragraph (2) of subdivision (d) of Section 79190.
(c)CA Water Code § 79550(c) Seventy million dollars ($70,000,000) for Delta levee restoration. Money expended pursuant to this subdivision shall be subject to Section 79050.
(d)CA Water Code § 79550(d) One hundred eighty million dollars ($180,000,000) for water supply reliability projects that can be implemented expeditiously and thereby provide near-term benefits, including, but not limited to, projects that facilitate groundwater management and storage, water transfers, and acquisition of water for the CALFED environmental water account. In acquiring water, preference shall be given to long-term water purchase contracts and water rights. Money allocated pursuant to this subdivision shall be subject to Article 4 (commencing with Section 79205.2) of Chapter 9 of Division 26.
(e)CA Water Code § 79550(e) One hundred eighty million dollars ($180,000,000) for ecosystem restoration program implementation of which not less than twenty million dollars ($20,000,000) shall be allocated for projects that assist farmers in integrating agricultural activities with ecosystem restoration.
(f)CA Water Code § 79550(f) Ninety million dollars ($90,000,000) for watershed program implementation.
(g)CA Water Code § 79550(g) One hundred eighty million dollars ($180,000,000) for urban and agricultural water conservation, recycling, and other water use efficiency projects.

Section § 79551

Explanation

This law section requires that any funding provided under this chapter must include money for independent scientific review, monitoring, and evaluation of how effective a project or program is.

All appropriations pursuant to this chapter shall include money for independent scientific review, monitoring, and assessment of the results or effectiveness of the project or program expenditure.

Section § 79552

Explanation

This law requires that any project funded under this chapter must align with the CALFED Programmatic Record of Decision, ensuring that financial and operational plans follow the established guidelines for consistent and balanced execution.

All projects financed pursuant to this chapter shall be consistent with the CALFED Programmatic Record of Decision including its provisions regarding finance and balanced implementation.

Section § 79553

Explanation

This law section states that projects offering multiple benefits across different CALFED program areas should be prioritized. Additionally, it limits administrative expenses to no more than 5% of the total funds available from this chapter.

Consistent with the CALFED Programmatic Record of Decision, priority shall be given to projects that achieve multiple benefits across CALFED program elements. Not more than 5 percent of the money available pursuant to this chapter may be used for administrative costs.

Section § 79554

Explanation

This law states that any real estate bought with funds specified in certain parts of Section 79550 must be purchased only from people willing to sell their property.

All real property acquired with money appropriated or granted pursuant to subdivision (e) or (f) of Section 79550 shall be acquired from willing sellers.

Section § 79555

Explanation

This law mandates that starting from the fiscal year 2004-05, at least 50% of the funding for acquiring water under a specific section must be used for long-term commitments. This includes buying long-term water purchase contracts, acquiring permanent water rights, and covering related costs.

For the 2004–05 fiscal year, and each fiscal year thereafter, not less than 50 percent of the funds made available pursuant to subdivision (d) of Section 79550 for acquisition of water for the CALFED environmental water account shall be expended for long-term water purchase contracts, permanent water rights, and associated costs.
