Section § 2930

Explanation

This section defines terms used in the context of a motorcyclist safety program in California. 'Commissioner' refers to the head of the California Highway Patrol. 'Fund' refers to the California Motorcyclist Safety Fund, which presumably supports efforts to enhance motorcycle safety. 'Program' means the specific motorcyclist safety program established by the law.

(a)CA Vehicle Code § 2930(a) “Commissioner” means the Commissioner of the California Highway Patrol.
(b)CA Vehicle Code § 2930(b) “Fund” means the California Motorcyclist Safety Fund.
(c)CA Vehicle Code § 2930(c) “Program” means the motorcyclist safety program established in this article.

Section § 2931

Explanation

This section establishes a safety program specifically for motorcyclists, which is managed by the California Highway Patrol under the guidance of the commissioner.

A motorcyclist safety program is hereby established in the Department of the California Highway Patrol, to be administered by the commissioner.

Section § 2932

Explanation

This law section allows the commissioner to partner with public or private organizations to promote motorcycle safety. They can fund projects, sponsor efforts to raise awareness among motorists about motorcyclists, and support research to effectively communicate motorcycle safety.

The commissioner can form an advisory committee with various stakeholders to create a comprehensive motorcycle safety program. Standards will be adopted for training courses, including content and instructor qualifications. Regular and premier motorcyclist safety training programs will have different standards, and costs for the premier programs won't be capped or state-funded after 2008.

The commissioner may, through contracts with other public agencies or with private entities, do all of the following:
(a)CA Vehicle Code § 2932(a) Provide financial or other support to projects aimed at enhancing motorcycle operation and safety, including, but not limited to, motorcyclist safety training programs. The motorcyclist safety training programs shall comply with criteria which the commissioner, in consultation with other state agencies and national motorcycle safety organizations, may adopt to provide validated motorcyclist safety training programs in the state.
(b)CA Vehicle Code § 2932(b) Sponsor and coordinate efforts aimed at increasing motorists’ awareness of motorcyclists.
(c)CA Vehicle Code § 2932(c) Sponsor research into effective communication techniques to reach all highway users on matters of motorcyclist safety.
(d)CA Vehicle Code § 2932(d) Establish an advisory committee of persons from other state and local agencies with an interest in motorcycle safety; persons from the motorcycle industry; motorcycle safety organizations; motorcycle enthusiast organizations; and others with an interest in motorcycle safety, to assist in the establishment of a comprehensive program of motorcycle safety.
(e)CA Vehicle Code § 2932(e) Adopt standards for course content, contact hours, curriculum, instructor training and testing, and instructional quality control, and setting forth a maximum amount for course fees for the novice rider training course specified in subdivisions (g) and (i) of Section 12804.9.
(f)Copy CA Vehicle Code § 2932(f)
(1)Copy CA Vehicle Code § 2932(f)(1) Adopt standards for course content, contact hours, curriculum, instructor training and testing, and instructional quality control, for a premier motorcyclist safety training program. Motorcycle safety training courses offered under a premier motorcyclist safety training program shall meet all of the following requirements:
(A)CA Vehicle Code § 2932(f)(1)(A) Provide a core curriculum approved for the novice rider training course specified in subdivision (e).
(B)CA Vehicle Code § 2932(f)(1)(B) Additional course requirements established by the commissioner.
(2)CA Vehicle Code § 2932(f)(2) On and after January 1, 2008, the commissioner shall not impose a maximum amount for course fees for courses provided under the premier motorcyclist safety training program.
(3)CA Vehicle Code § 2932(f)(3) All administrative costs of a premier motorcyclist safety training program shall be paid for by the provider, and none of the costs shall be paid for by the state.

Section § 2933

Explanation

This law states that the commissioner cannot personally provide program services; instead, these services must be delivered through contracts or grants. Any public agencies that help or provide these services will be fully reimbursed for their expenses. Additionally, the commissioner is required to supervise and assess these contracts or grants to ensure compliance by those receiving the funding.

The commissioner shall not directly manage or provide program services. Any program service financed under this article shall be provided under contractual arrangements or grant funding. All public agencies assisting or providing program services under this article shall be fully reimbursed for their costs by the commissioner. The commissioner shall monitor and evaluate any contracts or grants executed pursuant to this article to ensure that the provisions of the contracts or grants are adhered to by the recipients.

Section § 2934

Explanation

This law establishes the California Motorcyclist Safety Fund, which is a special fund in the State Treasury. It outlines that the money in this fund is exclusively for funding motorcycle safety programs and related costs, as designated by the article. The legislature must approve any spending from this fund. Additionally, the commissioner cannot spend more money than what's already in the fund and cannot promise future funds as collateral.

(a)CA Vehicle Code § 2934(a) The California Motorcyclist Safety Fund is hereby created in the State Treasury. The money in the fund is available, when appropriated by the Legislature, to fund programs established pursuant to this article and to defray related costs incurred. Moneys in the fund are and shall be held as trust funds for the exclusive trust purposes specified in this article.
(b)CA Vehicle Code § 2934(b) The commissioner shall not in any way encumber moneys in the fund beyond that amount which is actually available in the fund at the time of encumbrance, and shall not in any manner pledge or encumber future revenues to accrue to the fund from any source.

Section § 2935

Explanation

This law mandates that when you first register or renew the registration of a motorcycle, you must pay an extra $2 fee along with any other required fees. This additional fee is then added to a specific fund.

The Department of Motor Vehicles shall, in addition to other fees, collect a fee of two dollars ($2) upon initial registration and renewal of registration of every motorcycle subject to registration fees. These additional fees shall be deposited in the fund.
