Section § 12000

Explanation

This law states that the Bureau of Automotive Repair, which is part of the Department of Consumer Affairs, is responsible for enforcing the rules outlined in this chapter. They must check and investigate retail outlets to make sure they are following the rules set by this chapter.

The Bureau of Automotive Repair in the Department of Consumer Affairs shall enforce the provisions of this chapter. The Bureau of Automotive Repair shall investigate and inspect retail outlets to insure compliance with this chapter.

Section § 12001

Explanation

If you own a business that sells and installs new parts in passenger cars, you must give your customers an invoice showing the brand or similar identification of the parts installed. If you sell and install used or factory rebuilt parts, the invoice must clearly mark these as used parts.

This rule doesn't apply to small fittings or devices needed to install these parts.

(a)CA Vehicle Code § 12001(a) Any person who sells and installs new parts in passenger cars, in the ordinary course of his business, shall provide the customer with an invoice which identifies by brand name, or other comparable designation, the part or parts installed.
(b)CA Vehicle Code § 12001(b) Any person who sells and installs used or factory rebuilt parts in passenger cars, in the ordinary course of his business, shall provide the customer with an invoice which specifically designates the used part or parts installed.
(c)CA Vehicle Code § 12001(c) This section shall not apply to any fitting or other device necessary to the installation of any new, used or factory rebuilt part subject to the provisions of this section.

Section § 12002

Explanation

This law makes it illegal for anyone to knowingly make, sell, or install vehicle parts that have been declared defective and recalled according to specific federal guidelines.

No person shall knowingly manufacture, sell, or install in any vehicle, any vehicle part which, under the provisions of Chapter 301 (commencing with Section 30101) of Part A of Subtitle VI of Title 49 of the United States Code, is, or has been, determined to be defective and subject to customer notification or recall.

Section § 12003

Explanation

Breaking any rule in this chapter is considered a misdemeanor, which is a type of crime less severe than a felony.

Any violation of this chapter shall be a misdemeanor.
