Section § 4900

Explanation

This section of the law defines key terms used within the division. "Department" refers to the Employment Development Department, and "Director" refers to the Director of Employment Development.

As used in this division:
(a)CA Unemployment Insurance Code § 4900(a) “Department” means the Employment Development Department.
(b)CA Unemployment Insurance Code § 4900(b) “Director” means the Director of Employment Development.

Section § 4901

Explanation

The director is required to create a report every two years for the Legislature, starting in 1994. This report, due by February 1st of each even-numbered year, should cover the department's plans for automation, including any improvement suggestions. These are intended for review by the legislative policy and financial committees.

The director shall prepare a biennial report to the Legislature, on or before February 1, 1994, and on or before February 1 of each even-numbered year thereafter, on the department’s automation plans, including any recommendation on improvements for the purpose of consideration by both policy and fiscal committees of the Legislature.

Section § 4902

Explanation

This regulation mandates that a specific report be given to various government bodies by February 1 of each even-numbered year. This report must include: 1) A long-term strategic technology plan outlining goals and strategies to improve how the department uses information technology over a 10-year period. It should align with the department's business objectives and detail its information management principles and vision. 2) A shorter-term, tactical plan covering specific projects over the next three years, including project details, costs, benefits, and any expected savings in personnel and operation. 3) Clarifies that this report does not replace existing reports provided to the California Department of Technology.

The report, required by Section 4901, shall be transmitted to the Legislative Analyst, the Assembly Committees on Insurance, Labor and Employment, and Budget, the Senate Committees on Industrial Relations and Budget and Fiscal Review, the Department of Finance, and the Governor, on or before February 1 of each even-numbered year. The report shall do all of the following:
(a)CA Unemployment Insurance Code § 4902(a) Provide a strategic information technology plan that describes the long-term goals and strategies which shall be undertaken by the department to create an information technology environment that will not only support the achievement of the department’s strategic business mission and goals but set the foundation for using information technology to make substantial and sustainable improvements in how it conducts business. The plan shall cover a 10-year planning horizon and include the department’s information vision, its information management principles, and long-term goals and strategies for achieving its information vision.
(b)CA Unemployment Insurance Code § 4902(b) Provide a tactical information plan of specific automation and infrastructure projects to be undertaken within three years of the date of the report. The plan shall include project description and scope, consistency with the strategic information plan, relationship to other projects, priority of development, estimated project costs and benefits, and improvements in services. For automation projects, it shall also provide reductions in personnel and operating costs, and identification of how personnel and cost savings will be used, transferred, or otherwise accounted for.
(c)CA Unemployment Insurance Code § 4902(c) Not necessarily be in addition to or replace any reports now submitted by the director to the California Department of Technology.

Section § 4903

Explanation

This law section requires that 30 days before releasing a specific report, the director must send it to the California Department of Technology for review. The department will then comment on the report and their feedback must be attached for distribution. In their review, the department should check if the report meets required standards, matches the strategic plan they received separately, and if the costs and benefits align with projects approved or listed in the annual plans.

(a)CA Unemployment Insurance Code § 4903(a) Thirty days prior to the release of the report identified in Section 4901, the director shall submit it to the California Department of Technology, which shall review and comment on it. These comments shall be attached to the report by the director and distributed with the report.
(b)CA Unemployment Insurance Code § 4903(b) When commenting on the report, the California Department of Technology shall include, but not be limited to, an assessment of whether:
(1)CA Unemployment Insurance Code § 4903(b)(1) The requirements for the report have been met.
(2)CA Unemployment Insurance Code § 4903(b)(2) The strategic plan is consistent with the formal strategic plan submitted separately to the California Department of Technology.
(3)CA Unemployment Insurance Code § 4903(b)(3) The costs and benefits identified in the report are consistent with the projects previously submitted for approval or contained in the Information Management Annual Plans.
