Section § 885

Explanation

This law section states that multiple issues such as traffic congestion, air and noise pollution, public health challenges, energy shortages, high consumer costs, and land-use problems are reasons why it's important to develop transportation systems that use more than just cars.

The Legislature hereby finds and declares that traffic congestion, air pollution, noise pollution, public health, energy shortages, consumer costs, and land-use considerations resulting from a primary reliance on the automobile for transportation are each sufficient reasons to provide for multimodal transportation systems.

Section § 885.1

Explanation

This section simply states the official name of the law: it's called the Protected Bikeways Act of 2014.

This chapter shall be known, and may be cited, as the Protected Bikeways Act of 2014.

Section § 885.2

Explanation

This section explains that California recognizes its bicycle programs are underdeveloped and insufficiently funded. It emphasizes the importance of reducing traffic congestion and improving air quality through better bicycle infrastructure. Key components of successful bicycle programs include safe facility design, educating both cyclists and drivers, and enforcing traffic laws. Efforts to improve bike safety and convenience are deemed appropriate uses of transportation funds. The law also highlights that many bridges and highways are not designed for bicycles, yet bicycles are a legitimate form of transportation that can reduce car use, air pollution, and traffic congestion.

The Legislature finds and declares all of the following:
(a)CA Streets And Highways Code § 885.2(a) California’s bicycle programs have not been fully developed or funded.
(b)CA Streets And Highways Code § 885.2(b) The Legislature and Congress have enacted laws to reduce traffic congestion and improve air quality.
(c)CA Streets And Highways Code § 885.2(c) The components of a successful bicycle program include engineering and design of safe facilities, education of bicyclists, and the motoring public on lawful use of the highways, and enforcement of traffic laws.
(d)CA Streets And Highways Code § 885.2(d) Efforts to improve safety and convenience for nonmotorized transportation users are a proper use of transportation funds.
(e)CA Streets And Highways Code § 885.2(e) The design and maintenance of many of our bridges and highways present physical obstacles to use by bicycles.
(f)CA Streets And Highways Code § 885.2(f) The bicycle is a legitimate transportation mode on public roads and highways.
(g)CA Streets And Highways Code § 885.2(g) Bicycle transportation can be an important, low-cost strategy to reduce reliance on the single-passenger automobile and can contribute to a reduction in air pollution and traffic congestion.

Section § 886

Explanation

This law states that there is a position within the department dedicated to overseeing all activities related to bicycles. This person is known as the bicycle facilities coordinator.

There is in the department a bicycle facilities coordinator who is responsible for the administration of bicycle-related activities of the department.
