Section § 179

Explanation

Starting June 30, 2002, any money in the Seismic Safety Retrofit Account was moved to the State Highway Account. If there were any unpaid obligations from the Seismic Safety Retrofit Account before this date, they would be settled from the State Highway Account.

Effective June 30, 2002, all funds in the Seismic Safety Retrofit Account in the State Transportation Fund are transferred to the State Highway Account in the State Transportation Fund. Any outstanding encumbrances as of June 30, 2002, in the Seismic Safety Retrofit Account shall be paid from the State Highway Account.

Section § 179.1

Explanation

This law allows a department to manage projects aimed at improving the seismic safety of local bridges, in line with specific regulations set out in another chapter of the legal code.

The department may administer projects for local bridge seismic safety retrofits consistent with the requirements of Chapter 9 (commencing with Section 2400) of Division 3.

Section § 179.2

Explanation

This law allows the department to use state highway funds instead of requiring local governments to match funds for certain transportation projects. However, this is only possible if the annual Budget Act includes funding for this purpose.

The department may allocate State Highway Account funds in lieu of the local matching requirements of subdivision (b) of Section 2413 to the extent funding for this purpose is included in the annual Budget Act.

Section § 179.3

Explanation

This law defines key terms related to bridge projects, specifically those involving publicly owned pedestrian and rail transit bridges. The term “bridge” covers these types of public structures. Additionally, “retrofit” refers to either modifying an existing bridge structurally or replacing it entirely with a new one that meets earthquake safety standards.

For purposes of this article:
(a)CA Streets And Highways Code § 179.3(a) “Bridge” includes a publicly owned pedestrian bridge and a publicly owned rail transit bridge.
(b)CA Streets And Highways Code § 179.3(b) “Retrofit” includes both the structural modification of an existing bridge and the replacement of an existing bridge by a newly constructed bridge meeting seismic safety requirements.
