Boulevard DistrictsFormation Petition
Section § 26020
This law explains that a boulevard district can be created from any part of a county that isn't already part of an existing boulevard district. Once established, the district should be named as '_______ boulevard district' using the district's name, followed by 'of ______ county', indicating the county's name where it's located.
Section § 26021
To form a new district, at least 10 property owners in the area must sign a petition submitted to the county's board of supervisors. The petition should include the proposed district's name, the boundaries and population within those boundaries, details about the land area and its assessed value, and a request to hold an election to decide on forming a district for boulevard construction and maintenance.
Section § 26022
When a group wants to create a district, they must file a bond of up to $300 with the board of supervisors. This bond covers the costs of the election if the proposal to form the district is not approved.
Section § 26023
This law section states that when a petition is filed with the board of supervisors, they must schedule a hearing. The hearing date must be set for no sooner than 20 days and no later than 60 days from when the petition is presented.
Section § 26024
The board of supervisors must announce that a petition has been filed. They will provide details about when and where the petition will be reviewed and ask anyone interested to come and explain why the petition should or should not be approved.
Section § 26025
This law requires that a notice must be published weekly for two weeks in a newspaper that is printed and distributed within the proposed district. If there isn't a newspaper in that district, the notice should be published in one available at the county seat of the relevant county.
Section § 26026
The board of supervisors will listen to the petition and any objections on the scheduled day. They can postpone the hearing, but only for a total of up to 60 days.
