Section § 26040

Explanation

This law gives the board of supervisors the authority to adjust the final boundaries of a district. They can remove any land that they determine should not have been included in the district.

In fixing the final boundaries of the district the board of supervisors may exclude any lands which it finds have been improperly included.

Section § 26041

Explanation

This law allows the board of supervisors to expand a land district to include nearby lands. They can do this either if the landowners request it or by giving public notice of their intent to include the lands. If they're going to include lands by notice, the notice must be published just like the original hearing notice was.

The board of supervisors may include any lands adjacent to those described in the petition, either on:
(a)CA Streets And Highways Code § 26041(a) Petition of the owners of the adjacent lands; or
(b)CA Streets And Highways Code § 26041(b) Upon notice of its intention to include the adjacent lands within the district.
If the lands are included upon notice, the notice shall be published in the same manner and for the same time as the original notice of hearing.

Section § 26042

Explanation

This law section requires that if there's a plan to include nearby lands in a new district, those plans must be clearly stated and refer to an existing petition. Everyone interested should be informed about the time and place to present their reasons if they disagree with including those lands in the district.

The notice of intention to include adjacent lands shall refer to the petition for the formation of the district on file with the board of supervisors, shall describe the adjacent territory intended to be included within the proposed boundaries of the proposed district and direct all persons interested to appear at a specified time and place and show cause if any there be why the described lands should not be included within the district.

Section § 26043

Explanation

This law section explains that when there's a request (petition) and information provided during hearings, the board of supervisors is responsible for setting and officially recording the lines that define a district's boundaries.

Upon the petition and evidence produced at the hearings the board of supervisors shall determine and fix the boundaries of the district and shall, by order entered in its minutes, define and establish such boundaries.
