Section § 26060

Explanation

Once the boundaries of a proposed district are set, the local board of supervisors must arrange an election within 30 days to decide if the district should be formed. The election must occur within 60 days from when the order is made.

The order must specify the election date, the boundaries of the district, and note that a commission member will be elected. This order, recorded in the board's minutes, confirms that a valid petition was presented, that the petitioners are landowners in the district, and that all prior steps, such as hearings and boundary setting, were correctly completed.

Within 30 days after the establishment of the boundaries of the district, the board of supervisors shall, by order, call an election to be held in the proposed district for the purpose of determining whether or not the district shall be formed.
The order shall:
(a)CA Streets And Highways Code § 26060(a) Fix the day of the election, which shall be within 60 days after the date of the order.
(b)CA Streets And Highways Code § 26060(b) Show the boundaries of the proposed district.
(c)CA Streets And Highways Code § 26060(c) State that at the election one member of the commission will be voted for.
This order shall be entered in the minutes of the board and shall be conclusive evidence of:
(a)CA Streets And Highways Code § 26060(a) The due presentation of a proper petition.
(b)CA Streets And Highways Code § 26060(b) The fact that each of the petitioners was, at the time of the signing and presentation of the petition, a freeholder owning land within the proposed district.
(c)CA Streets And Highways Code § 26060(c) The fact that all other steps preliminary to the making of the order, including the hearing of the petition and establishment of the boundaries of the district, have been properly taken.

Section § 26061

Explanation

Before an election in a proposed district, notice must be given by posting a copy of the election order in three public places in the district for three weeks in a row. Additionally, the order has to be published in a local newspaper once a week for three weeks. If there isn't a local paper, it should be published in a newspaper at the county seat.

Notice of the election shall be given by posting a copy of the order for three successive weeks prior to the election, in three public places within the proposed district, and by publication of a copy of the order at least once a week for three successive weeks prior to the election in a newspaper published in the proposed district, if there be one, and if not, in a newspaper published at the county seat of the county in which the district is located.

Section § 26062

Explanation

Before an election in a proposed district, the local board of supervisors must choose polling places at least 15 days ahead and organize everything needed for the election. They must appoint an inspector and two judges from the local voters to oversee the election. If these officials aren't appointed or don't show up, voters at the polling place can pick replacements.

At least 15 days prior to the election, the board of supervisors shall select one or more polling places within the proposed district, and make all suitable arrangements for the holding of the election. It shall select and appoint from among the qualified electors of the proposed district one inspector and two judges of election in each polling place, who shall constitute the officers of the election and the election board. If no officers are so appointed or if any officer appointed does not attend at the opening of the polls on the morning of the election, the electors present may appoint substitutes to fill the election board.

Section § 26063

Explanation
During the election, one person will be chosen to serve on the commission for four years. This person will continue in their role until someone else is elected or appointed and ready to take over.
At the election there shall be elected one member of the commission, whose term of office shall be for four years and until the election, or appointment, and qualification of his successor.

Section § 26064

Explanation

When voting on forming a Boulevard District, the ballot will ask you to choose either 'Boulevard District—Yes' or 'Boulevard District—No.' Additionally, you'll also vote for one member of the district's commission.

The ballot shall contain the words “Boulevard District—Yes,” and “Boulevard District—No,” and shall also make provision for voting for one member of the commission.

Section § 26065

Explanation

After an election, the election officers send the results to the board of supervisors, who then review the results. If most voters agree to create a new district, the board makes an official record stating the district's name and boundaries and announces the election of the person with the most votes to the commission. This record proves that the district was properly created and all steps were followed correctly.

The officers of election shall make a return of the election to the board of supervisors, which shall canvass the returns as provided by law. If a majority of the votes cast at the election are in favor of creating the district the board of supervisors shall make and enter in its minutes an order declaring that the district of the name, and with the boundaries theretofore established (setting forth the boundaries), has been duly created, and shall declare the person receiving the highest number of votes for member of the commission, duly elected.
The order shall be conclusive evidence of the fact and of the regularity of all prior proceedings provided for by this part, and of the existence of, and the validity of the creation of, the district.

Section § 26066

Explanation

If most people vote against forming a district, the board of supervisors must officially record this decision. No new efforts to create the district can be started for at least one year from when the original request was submitted.

If a majority of the votes cast are against the creation of the district, the board of supervisors shall by order entered in its minutes so declare, and no other proceeding shall be taken in relation thereto until the expiration of one year from the date of the presentation to the board of supervisors of the petition pursuant to which the election was called.
