Section § 240200

Explanation

This law states that the commission has the legal ability to both initiate lawsuits and be a defendant in them, unless another law says differently. It can engage in legal actions in any court or tribunal that has the authority to hear such cases.

The commission may sue and be sued, except as otherwise provided by law, in all actions and proceedings, in all courts and tribunals of competent jurisdiction.

Section § 240201

Explanation

This law states that any claims for money or damages against the commission must follow the rules set out in a specific part of the Government Code, starting at Section 810. There may be exceptions if other laws or regulations specifically apply to those claims.

All claims for money or damages against the commission are governed by Division 3.6 (commencing with Section 810) of Title 1 of the Government Code except as provided therein, or by other statutes or regulations expressly applicable thereto.

The commission may make contracts and enter into stipulations of any nature whatsoever, including, but not limited to, contracts and stipulations to indemnify and hold harmless, to employ labor, and to do all acts necessary and convenient for the full exercise of the powers granted in this division.

Section § 240203

Explanation

This law allows the commission to make agreements with U.S. departments, public agencies like the Department of Transportation, local governments such as counties and cities, or even private individuals. These deals can be made when the commission believes it is beneficial.

The commission may contract with any department or agency of the United States of America, with any public agency, including, but not limited to, the Department of Transportation, any transit development board, county, or city, or with any person upon any terms and conditions that the commission finds is in its best interest.
