Section § 142100

Explanation

This section outlines how the authority selects its leadership. At the first meeting and then every January, they elect a chairperson and a vice chairperson. The chairperson leads the meetings, but if both are absent, the attending members can choose someone temporarily to act as the chairperson with full authority.

The authority, at its first meeting, and thereafter annually at the first meeting in January, shall elect a chairperson who shall preside at all meetings, and a vice chairperson who shall preside in his or her absence. In the event of their absence or inability to act, the members present, by an order entered into the minutes, shall select one of their members to act as chairperson pro tempore, who, while so acting, shall have all the authority of the chairperson.

Section § 142101

The authority shall adopt rules for its proceedings consistent with the law of the state.

Section § 142102

Explanation

For the authority to conduct business, over half of its members must be present. Any official decision or action requires the agreement of the majority of these members.

A majority of the members of the authority constitutes a quorum for the transaction of business, and all official acts of the authority require the affirmative vote of the majority of the members of the authority.

Section § 142103

Section § 142104

Explanation

This law mandates that all meetings held by the authority must follow certain rules outlined in a specific part of the Government Code. These rules ensure meetings are conducted openly and transparently.

All meetings of the authority shall be conducted pursuant to Chapter 9 (commencing with Section 54950) of Part 1 of Division 2 of Title 5 of the Government Code.

Section § 142105

Explanation

The authority is required to perform several key functions. It must create an annual budget and set up an administrative code to define officer roles, employee appointments, and operations management. Additionally, it needs to ensure a certified public accountant conducts an annual financial review. The authority also has to form a policy advisory committee with elected officials from each local city and the county, ensuring members are only current officials and are not part of the authority. A citizens oversight committee must also be established, following guidelines in the initial expenditure plan related to tax extension. Lastly, the authority should do whatever else is necessary to fulfill its duties.

The authority shall do all the following:
(a)CA Public Utilities Code § 142105(a) Adopt an annual budget.
(b)CA Public Utilities Code § 142105(b) Adopt an administrative code, by ordinance, which prescribes the powers and duties of the authority officers, the method of appointment of the authority employees, and methods, procedures, and systems of operations and management of the authority.
(c)CA Public Utilities Code § 142105(c) Cause a postaudit of the financial transactions and records of the authority to be made at least annually by a certified public accountant.
(d)CA Public Utilities Code § 142105(d) Appoint a policy advisory committee composed of one representative of each city in the county and one representative of the county. Each representative on the committee shall be an elected official. If a representative ceases to be an elected official, that representative shall cease to be a member of the committee, and another representative from that city or county, as the case may be, shall be appointed. No person shall serve on the authority and on the committee at the same time.
(e)CA Public Utilities Code § 142105(e) Establish a citizens oversight committee with membership, method of appointment, roles, and responsibilities in accordance with and as defined in the initial expenditure plan prepared for the purposes of the extension of the retail transactions and use tax.
(f)CA Public Utilities Code § 142105(f) Do any and all things necessary to carry out the purposes of this division.

Section § 142106

Explanation

This rule allows the authority to either employ its own staff or work with federal or public agencies to carry out its responsibilities.

The authority may hire an independent staff of its own or contract with any department or agency of the United States or with any public agency to implement this division.

Section § 142107

Explanation

This section means that the organization, referred to as 'the authority,' has the power to decide how much to pay its officers and employees.

The authority shall fix the compensation of its officers and employees.

Section § 142108

Explanation

Before adopting the annual budget, a notice about the public hearing's date and location must be published at least 15 days in advance. The proposed budget must also be available for the public to review at least 15 days before the hearing.

(a)CA Public Utilities Code § 142108(a) Notice of the time and place of a public hearing on the adoption of the annual budget shall be published pursuant to Section 6061 of the Government Code not later than the 15th day prior to the day of the hearing.
(b)CA Public Utilities Code § 142108(b) The proposed annual budget shall be available for public inspection at least 15 days prior to the hearing.

Section § 142109

Explanation

This law encourages the authority responsible for transportation planning to use existing planning resources and expertise instead of creating a new and potentially redundant team. Additionally, it restricts the authority from spending more than 1% of its funds on staff salaries and benefits annually.

(a)CA Public Utilities Code § 142109(a) The authority shall rely, to the extent possible, on existing state, regional, and local transportation planning and programming data and expertise, rather than on a large duplicative staff and set of plans.
(b)CA Public Utilities Code § 142109(b) The authority shall not expend more than 1 percent of the funds generated pursuant to this division in any year for salary and benefits of its staff.
