Section § 132800

Explanation

This law establishes the Imperial County Transportation Commission as an official body. It will take over responsibilities, assets, and debts from the Imperial Valley Association of Governments. The commission's authority covers the entire Imperial County, including both cities and rural areas.

There is hereby created the Imperial County Transportation Commission. The commission shall be the successor agency to the Imperial Valley Association of Governments and shall assume all assets and liabilities of that entity. The area of jurisdiction of the commission shall consist of all of the incorporated and unincorporated area of Imperial County.

Section § 132801

Explanation

This section outlines the composition of the governing board for a specific commission in Imperial County. The board includes two members from the Imperial County Board of Supervisors, mayors or council members from each city in the county, and one director from the Imperial Irrigation District. These members lose their position if they no longer hold office or are replaced. Additionally, there is a nonvoting member representing the Department of Transportation, appointed by the Governor. The board may also include nonvoting members from Baja California, Mexicali, a Mexican consul, and a Native American tribe in the region.

(a)CA Public Utilities Code § 132801(a) The governing board of the commission shall consist of the following members:
(1)CA Public Utilities Code § 132801(a)(1) Two members of the Imperial County Board of Supervisors. The term of a member under this paragraph terminates when he or she ceases to hold that office or when replaced by the board of supervisors.
(2)CA Public Utilities Code § 132801(a)(2) One member from each incorporated city within Imperial County who shall be the mayor of the city or a member of its city council. The term of a member under this paragraph terminates when he or she ceases to hold that office or when replaced by the city council.
(3)CA Public Utilities Code § 132801(a)(3) One member of the board of directors of the Imperial Irrigation District. The term of a member under this paragraph terminates when he or she ceases to hold that office or when replaced by the board of directors of the district.
(4)CA Public Utilities Code § 132801(a)(4) One nonvoting member appointed by the Governor representing the Department of Transportation.
(b)CA Public Utilities Code § 132801(b) The governing board of the commission may also include the following nonvoting members:
(1)CA Public Utilities Code § 132801(b)(1) One member representing the State of Baja California, Mexico, who may be appointed by the governor of the state.
(2)CA Public Utilities Code § 132801(b)(2) One member representing the municipality of Mexicali, Mexico, who may be the mayor or his or her designee.
(3)CA Public Utilities Code § 132801(b)(3) One member representing the Consul of Mexico in Calexico, California, who may be the consul or his or her designee.
(4)CA Public Utilities Code § 132801(b)(4) One member representing any federally recognized Native American tribe in Imperial County.
