Section § 96750

Explanation

This section explains that new areas can be added to the district using the procedures outlined in this chapter.

Territory may be annexed to the district in the manner provided in this chapter.

Section § 96751

Explanation

This law says that if the board decides that a particular area would gain advantages by becoming part of the district, they must officially declare this through a resolution.

Whenever the board finds and determines that additional territory will be benefited by annexation to the district, it shall pass a resolution to that effect.

Section § 96752

Explanation

To pass this resolution, two-thirds of the board members must vote in favor, and the county's board of supervisors must approve it as well. This applies specifically to the territory in question.

The resolution shall be passed by a vote of two-thirds of the members of the board and be approved by the board of supervisors of the county in which the territory is situated.

Section § 96753

Explanation

This law section outlines what a resolution must include when proposing an annexation of territory. It must describe the boundaries of the area to be annexed and give the annexation a specific name. The resolution must declare that the annexation will benefit the district and provide details about when and where people can voice their objections to the proposal.

The resolution shall:
(a)CA Public Utilities Code § 96753(a) Describe the boundaries of the territory proposed to be annexed.
(b)CA Public Utilities Code § 96753(b) Designate the proposed annexation by an appropriate name.
(c)CA Public Utilities Code § 96753(c) Declare that the area to be annexed to the district will be benefited by such annexation.
(d)CA Public Utilities Code § 96753(d) Name the time and place for the hearing of objections by any person interested in the proposed annexation.

Section § 96754

Explanation

This section requires that any resolution, along with the names of board members who voted on it, be published in a local newspaper in the area being annexed. If no local newspaper exists, it must be published in a widely circulated newspaper in that area, following the publication guidelines of Section 6066 of the Government Code.

The resolution, together with the names of the members of the board, voting for and against it shall be published pursuant to Section 6066 of the Government Code in a newspaper published in the territory proposed to be annexed, or if there is no such paper, then in some newspaper of general circulation, circulated in such territory.

Section § 96755

Explanation

This law section outlines the process for a board to handle objections to the annexation of a territory. During a scheduled hearing, the board listens to any concerns raised about annexation. If two-thirds of the board members agree that the annexation will benefit the territory, they will then determine the specific boundaries of the area to be added to the district.

On the day fixed for hearing or any day to which the hearing is adjourned, the board shall hear and consider any objections presented to the annexation of the territory. After the hearing of objections, if it shall be determined by a vote of two-thirds of all the members of the board that the territory proposed to be annexed will be benefited by such annexation, the board shall proceed to fix and determine the boundaries of the territory to be annexed to the district.

Section § 96756

Explanation

This law section states that a board can annex a territory after making necessary changes to its boundaries. To do this, a resolution must be passed with a two-thirds majority vote from the board members. The details of the resolution and the names of the board members who voted for and against it must be recorded in the board's minutes.

After making all necessary and proper changes in the boundaries, by a resolution passed by a vote of two-thirds of the members, the board shall order the annexation of the territory so described. The resolution, together with the names of the members of the board voting for and against the same shall be spread upon the minutes of the board.

Section § 96757

Explanation

When a new area is added to an existing district, it automatically becomes part of that district. This means it will share both the responsibilities and advantages that come with being in that district.

Whenever any territory is annexed to the district it shall thereupon become a part of the district subject to all the liabilities and entitled to all the benefits of the district.
