Section § 105280

Explanation

This section explains that new areas can be added to the district using the procedures outlined in this chapter.

Territory may be annexed to the district in the manner provided in this chapter.

Section § 105281

Explanation

This law allows a county that shares a border with a district to request to join the district by a majority vote of the county's board of supervisors. Alternatively, the district's board itself can suggest adding new territories that are next to the district.

A county contiguous to the district may, by majority vote of the board of supervisors of that county, petition the district to annex all or part of the territory within the county. Alternatively, the board of the district may propose annexation of any territory contiguous to the district.

Section § 105282

Explanation

If someone proposes to annex additional land to a district, the board must first decide if this territory will benefit from joining the district. They then need to pass a resolution with a two-thirds majority vote. Afterward, the county's board of supervisors must approve this resolution.

If annexation is proposed pursuant to Section 105281, the board shall determine whether the additional territory proposed to be annexed will be benefited by annexation to the district, and shall pass a resolution to that effect. The resolution shall be passed by a vote of two-thirds of the members of the board and be approved by the board of supervisors of the county in which the territory is situated.

Section § 105283

Explanation

This law section states that when a county wants to annex a piece of territory, the county's board of supervisors must come to a written agreement with the district's board of directors about the terms of annexation. This agreement can include things like additional taxes, different rates for services, taking on new debts, making payments, and transferring property or assets to the district.

The board of supervisors of the county in which the territory to be annexed is situated shall agree in writing with the board of directors of the district upon the terms and conditions of annexation. The agreement may provide for the levy and collection of special taxes within the county in addition to the taxes elsewhere provided for in this part, the fixing of rates, rentals, and charges differing from those fixed or existing elsewhere within the district, the incurring or assumption of indebtedness, the making of a payment or payments, or the transfer of property, real and personal, and other assets to the district by the county.

Section § 105284

Explanation

This section outlines what must be included in a resolution when proposing an annexation of territory to a district. It requires a description of the territory's boundaries and an appropriate name for the annexation. It must also state that the annexed area will benefit from joining the district. Additionally, it should specify the time and place for a hearing where interested parties can voice objections. Finally, any agreed terms and conditions of the annexation between the district and the county must be described.

The resolution shall:

(e)CA Public Utilities Code § 105284(e) Describe any terms and conditions of annexation agreed to between the district and the county pursuant to Section 105283.

Section § 105285

Explanation

Whenever a resolution is passed regarding the annexation of a territory, the resolution and the voting details of board members must be published in a local newspaper. If the territory doesn't have a local paper, then it should be published in a newspaper that circulates in that area.

The resolution, together with the names of the members of the board voting for and against it, shall be published pursuant to Section 6066 of the Government Code in a newspaper published in the territory proposed to be annexed, or if there is no paper, then in some newspaper of general circulation, circulated in the territory.

Section § 105286

Explanation

This law outlines the process for annexing a territory into a district. On a scheduled hearing day, or any rescheduled day, the board listens to objections about the annexation. If two-thirds of the board members agree that the area will benefit from joining the district, they will then set the new boundaries for the annexed territory.

On the day fixed for hearing or on any day to which the hearing is adjourned, the board shall hear and consider any objections presented to the annexation of the territory. After the hearing of objections, if it is determined by a vote of two-thirds of all the members of the board that the territory proposed to be annexed will be benefited by annexation, the board shall proceed to fix and determine the boundaries of the territory to be annexed to the district.

Section § 105287

Explanation

This law section states that if a board wants to annex a certain territory, they need to first make any necessary adjustments to the boundaries. Then, at least two-thirds of the board members must vote in favor of annexation. The resolution and the details of the vote—including who voted for and against it—must be recorded in the board's minutes.

After making all necessary and proper changes in the boundaries, by a resolution passed by a vote of two-thirds of the members, the board shall order the annexation of the territory so described. The resolution, together with the names of the members of the board voting for and against the same shall be set forth in the minutes of the board.

Section § 105288

Explanation

When a new area is added to an existing district, it automatically becomes part of that district. This means it will share both the responsibilities and advantages that come with being in that district.

Whenever any territory is annexed to the district it shall thereupon become a part of the district subject to all the liabilities and entitled to all the benefits of the district.
