Section § 98390

Explanation

This law section explains that new territory can be added to an existing district even if it doesn't touch the current district's boundaries. The process for this annexation is outlined in this chapter.

Territory may be annexed to the district in the manner provided in this chapter. Territory to be annexed need not be contiguous to the present district.

Section § 98391

Explanation

This law explains that if a board believes an area would benefit from joining its district, it must pass a resolution to start the annexation process. Before the board can hold a hearing, it needs approval from the local agency formation commission.

Whenever the board finds and determines that additional territory will be benefited by annexation to the district, it shall pass a resolution to that effect. Approval of the local agency formation commission shall be required for such annexation, and shall be obtained before the board holds its hearing.

Section § 98392

Explanation

This section outlines the requirements for a resolution to annex new territory to a district. A two-thirds majority vote from the board members is needed. The resolution must describe the area to be annexed, give it a name, state how the district will benefit, and set a hearing time and place for objections.

The resolution shall be passed by a vote of two-thirds of the members of the board and shall:
(a)CA Public Utilities Code § 98392(a) Describe the boundaries of the territory proposed to be annexed.
(b)CA Public Utilities Code § 98392(b) Designate the proposed annexation by an appropriate name.
(c)CA Public Utilities Code § 98392(c) Declare that the area to be annexed to the district will be benefited by such annexation.
(d)CA Public Utilities Code § 98392(d) Name the time and place for the hearing of objections by any person interested in the proposed annexation.

Section § 98393

Explanation

This section requires that any resolution, along with the names of board members who voted on it, be published in a local newspaper in the area being annexed. If no local newspaper exists, it must be published in a widely circulated newspaper in that area, following the publication guidelines of Section 6066 of the Government Code.

The resolution, together with the names of the members of the board, voting for and against it shall be published pursuant to Section 6066 of the Government Code in a newspaper published in the territory proposed to be annexed, or if there is no such paper, then in some newspaper of general circulation, circulated in such territory.

Section § 98394

Explanation

This law states that on the scheduled hearing day about adding new territory to a district, the board listens to any objections. After considering these objections, if at least two-thirds of the board members agree that the area will benefit from joining, they will then define the specific boundaries of the area to be included in the district.

On the day fixed for hearing or any day to which the hearing is adjourned, the board shall hear and consider any objections presented to the annexation of the territory. After the hearing of objections, if it shall be determined by a vote of two-thirds (2/3) of all the members of the board that the territory proposed to be annexed will be benefited by such annexation, the board shall proceed to fix and determine the boundaries of the territory to be annexed to the district.

Section § 98395

Explanation

This law states that once all necessary adjustments to territory boundaries have been made, the board can approve the annexation of that territory if at least two-thirds of its members vote in favor. The decision, along with the voting record, must be recorded in the board's minutes.

After making all necessary and proper changes in the boundaries, by a resolution passed by a vote of two-thirds of the members, the board shall order the annexation of the territory so described. The resolution together with the names of the members of the board voting for and against the same shall be spread upon the minutes of the board.

Section § 98396

Explanation

When a new area is added to an existing district, it automatically becomes part of that district. This means it will share both the responsibilities and advantages that come with being in that district.

Whenever any territory is annexed to the district it shall thereupon become a part of the district subject to all the liabilities and entitled to all the benefits of the district.
