San Joaquin Regional Transit DistrictAnnexation
Section § 50270
This section explains that new areas can be added to the district using the procedures outlined in this chapter.
Section § 50271
This law says that if the board decides that a particular area would gain advantages by becoming part of the district, they must officially declare this through a resolution.
Section § 50272
To pass this resolution, two-thirds of the board members must vote in favor, and the county's board of supervisors must approve it as well. This applies specifically to the territory in question.
Section § 50273
This section outlines what needs to be included in a resolution to annex a territory into a district. It requires a description of the territory, a name for the annexation, a statement that the annexation will benefit the area, and the details of the public hearing for any objections.
Section § 50274
This section requires that any resolution, along with the names of board members who voted on it, be published in a local newspaper in the area being annexed. If no local newspaper exists, it must be published in a widely circulated newspaper in that area, following the publication guidelines of Section 6066 of the Government Code.
Section § 50275
This law section outlines the process for a board to handle objections to the annexation of a territory. During a scheduled hearing, the board listens to any concerns raised about annexation. If two-thirds of the board members agree that the annexation will benefit the territory, they will then determine the specific boundaries of the area to be added to the district.
Section § 50276
This law section states that a board can annex a territory after making necessary changes to its boundaries. To do this, a resolution must be passed with a two-thirds majority vote from the board members. The details of the resolution and the names of the board members who voted for and against it must be recorded in the board's minutes.
Section § 50277
When a new area is added to an existing district, it automatically becomes part of that district. This means it will share both the responsibilities and advantages that come with being in that district.
