Section § 70270

Explanation

Section § 70271

Explanation

Section § 70273

Section § 70274

If no local newspaper exists, it must be published in a widely circulated newspaper in that area, following the publication guidelines of Section 6066 of the Government Code.

The resolution, together with the names of the members of the board, voting for and against it shall be published pursuant to Section 6066 of the Government Code in a newspaper published in the territory proposed to be annexed, or if there is no such paper, then in some newspaper of general circulation, circulated in such territory.

Section § 70275

Explanation

This law details the process for a board to hear objections to annexing a territory into a district. If two-thirds of the board agrees that the area will benefit from being annexed, they can outline the boundaries of the new district. However, if over half of the registered voters in the proposed area submit written protests before the hearing ends, the annexation process must be stopped. Additionally, the board cannot revisit the same annexation proposal for at least six months if it was terminated due to voter protests.

On the day fixed for hearing or any day to which the hearing is adjourned, the board shall hear and consider any objections presented to the annexation of the territory. After the hearing of objections, if it shall be determined by a vote of two-thirds of all the members of the board that the territory proposed to be annexed will be benefited by such annexation, the board shall proceed to fix and determine the boundaries of the territory to be annexed to the district, provided, however, that if there is filed with the clerk of the board prior to the close of said hearing, written protests against said annexation signed by fifty percent (50%) or more of the registered voters within the area proposed to be annexed, then said annexation proceedings shall be terminated by board action and the board shall not within six months after said termination adopt a resolution pursuant to Section 70271 applicable to the same or substantially the same area involved in the prior terminated proceeding.

Section § 70276

Section § 70277

Whenever any territory is annexed to the district it shall thereupon become a part of the district subject to all the liabilities and entitled to all the benefits of the district.
