Marin County Transit DistrictAnnexation
Section § 70270
This law states that areas in Marin County can be added to a district following the process outlined in this particular chapter.
Section § 70271
This law says that if the board decides that a particular area would gain advantages by becoming part of the district, they must officially declare this through a resolution.
Section § 70272
This law states that for a resolution to be approved, at least two-thirds of the board members must vote in favor of it.
Section § 70273
This law section outlines what a resolution for annexing territory must include. Firstly, it must clearly describe the boundaries of the area to be annexed. It must also assign an appropriate name to the proposed annexation. Additionally, the resolution should declare that the annexation will benefit the district involved. Lastly, it needs to specify the time and place for a hearing where anyone with concerns about the annexation can voice their objections.
Section § 70274
This section requires that any resolution, along with the names of board members who voted on it, be published in a local newspaper in the area being annexed. If no local newspaper exists, it must be published in a widely circulated newspaper in that area, following the publication guidelines of Section 6066 of the Government Code.
Section § 70275
This law details the process for a board to hear objections to annexing a territory into a district. If two-thirds of the board agrees that the area will benefit from being annexed, they can outline the boundaries of the new district. However, if over half of the registered voters in the proposed area submit written protests before the hearing ends, the annexation process must be stopped. Additionally, the board cannot revisit the same annexation proposal for at least six months if it was terminated due to voter protests.
Section § 70276
This law section states that a board can annex a territory after making necessary changes to its boundaries. To do this, a resolution must be passed with a two-thirds majority vote from the board members. The details of the resolution and the names of the board members who voted for and against it must be recorded in the board's minutes.
Section § 70277
When a new area is added to an existing district, it automatically becomes part of that district. This means it will share both the responsibilities and advantages that come with being in that district.
