Section § 22256

Explanation

This law says that a county's board of supervisors must officially create a special district if two voting conditions are met. First, more than half of all voters in the election must support forming the district. Second, more than half of the voters in most of the cities (including unincorporated areas treated as cities) within the district area must also support it.

By a resolution entered on its minutes, the board of supervisors of each affected county shall declare the district formed if:
(a)CA Public Utilities Code § 22256(a) A majority of the votes cast at the election is for the formation of the district.
(b)CA Public Utilities Code § 22256(b) A majority of the votes cast in a majority in number of the cities included in whole or in part in the district, counting all of the unincorporated territory in each affected county as a city for this purpose, is for the formation of the district.

Section § 22257

Explanation

This law requires that any resolution must include the name of the district and clearly describe or designate the boundaries of that district.

The resolution shall contain the name of the district and a description or other designation of its boundaries.

Section § 22258

Explanation
Whenever a specific resolution is passed, a certified copy of it needs to be officially filed at the recorder's office in every county that is impacted by the resolution.
A certified copy of the resolution shall be recorded in the office of the recorder of each affected county.

Section § 22259

Explanation

This law states that once the necessary documents are filed with the Secretary of State, the creation of the district is officially finalized.

Upon the filing with the Secretary of State, the formation of the district is complete.
