Section § 22226

Explanation

After a hearing, if the board of supervisors in each affected county agrees to form an airport district, they must take several steps. They will officially define the district's boundaries, give it a name including 'airport district', and organize an election to decide whether to form the district and select a board of directors. The boards must set the election date and times, create voting precincts, choose polling places, and appoint election officers.

If after the hearing the board of supervisors of each affected county determines that the district should be formed, each board, by resolution entered on its minutes, shall:
(a)CA Public Utilities Code § 22226(a) Define and describe the boundaries of the district or otherwise designate its territorial extent.
(b)CA Public Utilities Code § 22226(b) State the name of the district, which shall contain the words “____________________ airport district.”
(c)CA Public Utilities Code § 22226(c) Call an election in the county, or portion thereof within the district, for the purpose of determining whether the district shall be formed and to elect a board of five directors for the district if formed.
(d)CA Public Utilities Code § 22226(d) Fix the date of the election and the hours the polls will be open.
(e)CA Public Utilities Code § 22226(e) Establish election precincts and designate polling places for the election.
(f)CA Public Utilities Code § 22226(f) Appoint the election officers.

Section § 22227

Explanation

This section requires that a resolution must be published in local newspapers according to a specific section of the Government Code. The publication has to occur in every county and city within the district, with the first announcement made at least 30 days before an election. If necessary, the resolution might be published in multiple newspapers if the county's board of supervisors decides so.

The resolution shall be published pursuant to Section 6066 of the Government Code in each county and city in the district. The first publication shall be at least 30 days prior to the date of the election. The resolution may be published in more than one newspaper by order of the board of supervisors of the affected county.

Section § 22228

Explanation

This law section specifies the wording for a ballot proposition when there's an election to decide whether to create a new airport district under the California Airport District Act. The proposition asks voters if they approve of forming the new airport district.

The proposition submitted at the election shall be “Shall the proposition to form ____________________ Airport District under the California Airport District Act be adopted?”

Section § 22229

Explanation

This law section states that unless specified otherwise, elections should follow the same procedures as those for general municipal elections in cities governed by general law. Except as otherwise provided in this article, the election shall be called, noticed, and conducted, candidates nominated, the vote canvassed, and the results declared in the manner prescribed by law for general municipal elections in general law cities and by the general laws so far as applicable.

Section § 22229.1

Explanation

When an election to form a new district is announced, the local government must send a written notice by registered mail to the local agency formation commission within five days. This announcement includes details about the proposed district. Next, the commission's executive officer, also within five days, must draft a neutral analysis of the district proposal, which can't be longer than 500 words and should clearly define the proposed boundaries. The commission then has five days to review, potentially adjust, and finalize this analysis before it's sent to the election officials.

Within five days after the district formation election has been called, the legislative body which has called the election shall transmit, by registered mail, a written notification of the election call to the executive officer of the local agency formation commission of the county or principal county in which the territory or major portion of the territory of the proposed district is located. Such written notice shall include the name and a description of the proposed district, and may be in the form of a certified copy of the resolution adopted by the legislative body calling the district formation election.
The executive officer, within five days after being notified that a district formation election has been called, shall submit to the commission, for its approval or modification, an impartial analysis of the proposed district formation.
The impartial analysis shall not exceed 500 words in length and shall include a specific description of the boundaries of the district proposed to be formed.
The local agency formation commission, within five days after the receipt of the executive officer’s analysis, shall approve or modify the analysis and submit it to the officials in charge of conducting the district formation election.

Section § 22229.2

Explanation

This law allows the board of supervisors, authorized members, individual voters, or associations of citizens to submit written arguments for or against forming a new district. These arguments must be concise, no longer than 300 words, and submitted at least 54 days before the election deciding on the district's formation.

The board of supervisors or any member or members of the board authorized by the board, or any individual voter or bona fide association of citizens entitled to vote on the district formation proposition, or any combination of such voters and associations of citizens, may file a written argument for or a written argument against the proposed district formation.
Arguments shall not exceed 300 words in length and shall be filed with the officials in charge of conducting the election not less than 54 days prior to the date of the district formation election.

Section § 22229.3

Explanation

This law explains how officials decide which arguments for and against a proposed district formation will be printed and distributed to voters. If there are multiple arguments, the officials must choose one from each side. They should prioritize arguments from the county's board of supervisors first, and then look at those submitted by individual voters or citizen groups.

If more than one argument for or more than one argument against the proposed district formation is filed with the election officials within the time prescribed, such election officials shall select one of the arguments for printing and distribution to the voters.
In selecting the arguments, the election officials shall give preference and priority in the order named to the arguments of the following:
(a)CA Public Utilities Code § 22229.3(a) The board of supervisors or any member or members of the board authorized by the board.
(b)CA Public Utilities Code § 22229.3(b) Individual voters or bona fide associations of citizens or a combination of such voters and associations.

Section § 22229.4

Explanation

This law requires election officials to prepare and send out a ballot pamphlet to everyone voting on whether to form a new district. The pamphlet must include the full text of the proposal, an unbiased analysis by the local agency, and arguments for and against the district formation. It must be mailed out at least 10 days before the election, and it is considered an 'official matter' under election law.

The officials in charge of conducting the election shall cause a ballot pamphlet concerning the district formation proposition to be voted on to be printed and mailed to each voter entitled to vote on the district formation question.
The ballot pamphlet shall contain the following in the order prescribed:
(a)CA Public Utilities Code § 22229.4(a) The complete text of the proposition.
(b)CA Public Utilities Code § 22229.4(b) The impartial analysis of the proposition prepared by the local agency formation commission.
(c)CA Public Utilities Code § 22229.4(c) The argument for the proposed district formation.
(d)CA Public Utilities Code § 22229.4(d) The argument against the proposed district formation.
The election officials shall mail a ballot pamphlet to each voter entitled to vote in the district formation election at least 10 days prior to the date of the election. The ballot pamphlet is “official matter” within the meaning of Section 13303 of the Elections Code.

Section § 22230

Explanation

This law outlines who has the authority for managing election-related responsibilities for a specific district. During the first election, the county's board of supervisors and its clerk handle these duties, much like city legislative bodies do according to related laws. After the first election, these responsibilities shift to the district's board of directors and its secretary.

At the first election the board of supervisors of each affected county and its clerk have the powers and duties vested in the legislative bodies of cities and their clerks by the general laws described in Section 22229. Thereafter the board of directors of the district and its secretary have these powers and duties.

Section § 22231

Explanation

This law section explains that the process of officially counting votes (known as canvassing) for the election must follow the specific rules set for special elections in each county that is affected.

The canvass of the returns of the election shall be made at the time, in the manner, and by the officers prescribed by law for special elections in each affected county.

Section § 22232

Explanation

This law states that if an election's results are reviewed by someone who is not part of the county's board of supervisors, that person must send the results to the board. The board of supervisors is responsible for officially announcing the election results.

If the canvass is made by an officer other than the board of supervisors of the affected county, the officer shall transmit the results to the board of supervisors. The board of supervisors shall declare the result of the election.
