Section § 42395

Explanation

This law defines what qualifies as a 'reusable' or 'refillable' propane cylinder. A propane cylinder is considered reusable if it is specifically designed and marketed for multiple uses with the same product, built to last through many uses, and there is infrastructure available to ensure it can be safely reused or refilled.

It also specifies that the law does not cover certain types of propane cylinders, including those that are used in the construction industry and contain less than 15 ounces of fuel, have a height-to-width ratio of 3.55 to 1 or greater, or are sold to government agencies through certain federal programs.

(a)CA Public Resources Code § 42395(a) For purposes of this chapter, “reusable” or “refillable” or “reuse” or “refill,” in regard to propane cylinders means a cylinder that satisfies all of the following:
(1)CA Public Resources Code § 42395(a)(1) Explicitly designed and marketed to be utilized multiple times for the same product.
(2)CA Public Resources Code § 42395(a)(2) Designed for durability to function properly in its original condition for multiple uses.
(3)CA Public Resources Code § 42395(a)(3) Supported by adequate infrastructure to ensure the cylinders can be conveniently and safely reused or refilled for multiple cycles.
(b)CA Public Resources Code § 42395(b) For purposes of this chapter, “propane cylinder” does not include any of the following:
(1)CA Public Resources Code § 42395(b)(1) Cylinders that are customarily designed for use in the construction industry and, when full, contain less than 15 ounces of fuel, whether filled solely with propane or not.
(2)CA Public Resources Code § 42395(b)(2) Cylinders that have an overall product height-to-width ratio of 3.55 to 1 or greater.
(3)CA Public Resources Code § 42395(b)(3) Cylinders that are offered to a state or local government agency for purchase pursuant to the United States General Services Administration’s State and Local Disaster Purchasing Program, or a successor program.

Section § 42395.1

Explanation

Starting January 1, 2028, California will only allow the sale of propane cylinders that can be reused or refilled.

On and after January 1, 2028, only reusable or refillable propane cylinders shall be sold or offered for sale in this state.

Section § 42395.2

Explanation

This law requires the department to create and implement rules for this chapter by January 1, 2028.

The department shall adopt regulations to implement this chapter with an effective date of January 1, 2028.
