Section § 42161

Explanation

A "metallic discard" is defined as any large metal item or product, or part of it. This includes metal furniture, machinery, major appliances, electronic products, and wood-burning stoves.

“Metallic discard” means any large metal article or product, or any part thereof, including, but not limited to, metal furniture, machinery, major appliances, electronic products, and wood-burning stoves.

Section § 42162

Explanation

"Salvage" refers to the careful and managed removal of metal items from a solid waste disposal site, specifically to recycle or reuse them. This process must occur at a facility that is authorized to handle such waste.

“Salvage” means the controlled removal of metallic discards from the solid waste stream at a permitted solid waste facility for the express purpose of recycling or reuse.

Section § 42163

Explanation
Recycling residue refers to leftover materials that are not hazardous, or have been treated to be nonhazardous, which come from recovering metals specifically for recycling purposes.
“Recycling residue” means nonhazardous residue or residue treated to be nonhazardous that is a direct result of metals recovery operations for the express purposes of recycling.

Section § 42164

Explanation

This section defines a "solid waste landfill" by referring to the definition provided in another section, specifically Section 40195.1.

“Solid waste landfill” means a solid waste landfill, as defined in Section 40195.1.

Section § 42165

Explanation

This law defines the term 'vehicle' to include anything used for transportation, such as bicycles, airplanes, cars, and other similar devices. It clarifies that this definition applies to transportation devices on and off highways, according to the Vehicle Code.

“Vehicle” means any device used for transportation. “Vehicle” includes bicycles, airplanes, and other transportation devices not used on highways, and automobiles and other vehicles, as defined in Section 670 of the Vehicle Code.

Section § 42166

Explanation

This section defines what is considered a 'major appliance' and includes both household and commercial devices. Examples include washing machines, dryers, refrigerators, stoves, and air conditioners, among others.

“Major appliance” means any domestic or commercial device, including, but not limited to, a washing machine, clothes dryer, hot water heater, dehumidifier, conventional oven, microwave oven, stove, refrigerator, freezer, air-conditioner, trash compactor, and residential furnace.

Section § 42167

Explanation

This law defines "materials that require special handling." These materials are hazardous and include items like unspent airbags with sodium azide, certain harmful chemicals in appliances like PCBs and DEHP, refrigerants in air-conditioning units, used oil from major appliances, and mercury in switches. It also covers any hazardous waste from appliances as regulated under specific health and safety laws.

“Materials that require special handling” means all of the following:
(a)CA Public Resources Code § 42167(a) Sodium azide canisters in unspent airbags that are determined to be hazardous by federal and state law or regulation.
(b)CA Public Resources Code § 42167(b) Encapsulated polychlorinated biphenyls (PCBs), Di(2-Ethylhexylphthalate) (DEHP), and metal encased capacitors, in major appliances.
(c)CA Public Resources Code § 42167(c) Chlorofluorocarbons (CFCs), hydrochlorofluorocarbons (HCFCs), and other non-CFC replacement refrigerants, injected in air-conditioning/refrigeration units.
(d)CA Public Resources Code § 42167(d) Used oil, as defined in subparagraph (A) of paragraph (1) of subdivision (a) of Section 25250.1 of the Health and Safety Code, in major appliances. Materials described in subparagraph (B) of paragraph (1) of subdivision (a) of Section 25250.1 of the Health and Safety Code are not excluded from the definition of used oil for the purposes of this section.
(e)CA Public Resources Code § 42167(e) Mercury found in switches and temperature control devices in major appliances.
(f)CA Public Resources Code § 42167(f) Any other material that, when removed from a major appliance, is a hazardous waste regulated pursuant to Chapter 6.5 (commencing with Section 25100) of Division 20 of the Health and Safety Code.

Section § 42168
