Section § 5091.25

Explanation

This statute explains how money from SNO-PARK parking permits is handled. When the permits are sold, the money goes into the state's Winter Recreation Fund.

The funds are used in two main ways: First, some of the money is allocated to the Department of Transportation to cover the costs of clearing snow from parking areas. Second, the remaining money is used to improve and maintain parking areas, add sanitation facilities, mark trailheads, and enhance safety for winter recreation activities. It's also used to educate the public about the SNO-PARK program and provide grants to counties for snow removal costs.

(a)CA Public Resources Code § 5091.25(a) Proceeds from the sale of SNO-PARK parking permits shall be paid to the State Treasury to the credit of the Winter Recreation Fund, which is hereby created.
(b)CA Public Resources Code § 5091.25(b) The moneys in the Winter Recreation Fund shall be allocated, when appropriated, as follows:
(1)CA Public Resources Code § 5091.25(b)(1) An amount equal to the actual and necessary costs incurred in the removal of snow from designated parking areas shall be paid to the Department of Transportation.
(2)CA Public Resources Code § 5091.25(b)(2) The balance of the funds shall be expended for the acquisition, lease, development, and maintenance of additional designated parking areas, for sanitation facilities, trailhead markings, and other facilities designed to promote the safety and well-being of persons engaged in winter recreation, and for grants to counties for the actual and necessary costs incurred in the removal of snow from designated parking areas, and to inform and educate the public about the program.

Section § 5091.26

Explanation

This law states that the government cannot use eminent domain, which is the power to take private property for public use, to acquire property for the purpose of creating a parking area.

Eminent domain shall not be exercised to acquire any interest in property for a designated parking area.

Section § 5091.27

Explanation

This law allows the department responsible for this chapter to create and enforce rules and regulations needed to put the chapter into practice.

The department may adopt rules and regulations necessary to implement and enforce this chapter.
