Explanation

If a trust document doesn't say otherwise, all trustees need to agree unanimously before making a decision under their given powers.

Unless otherwise provided in the trust instrument, a power vested in two or more trustees may only be exercised by their unanimous action.

Section § 15621

Explanation

If a vacancy happens among two or more trustees (cotrustees) and the trust document doesn't specify what to do, the remaining trustee(s) can continue to manage the trust as if they are the only ones in charge.

Unless otherwise provided in the trust instrument, if a vacancy occurs in the office of a cotrustee, the remaining cotrustee or cotrustees may act for the trust as if they are the only trustees.

Explanation

If a co-trustee of a trust is temporarily unable to perform their duties, like being sick or away, the other co-trustees can step in and act as if they are the sole trustees. They can do this when it's necessary to fulfill the trust's goals or to prevent damage to the trust's assets.

Unless otherwise provided in the trust instrument, if a cotrustee is unavailable to perform the duties of the cotrustee because of absence, illness, or other temporary incapacity, the remaining cotrustee or cotrustees may act for the trust, as if they are the only trustees, where necessary to accomplish the purposes of the trust or to avoid irreparable injury to the trust property.
