Section § 71530

Explanation

The California Endowment for Marine Preservation is set up to support marine conservation efforts. It follows the rules in this section and the rules for nonprofit organizations. If there's ever a conflict between these two, the rules in this section will take priority.

The California Endowment for Marine Preservation is hereby established. The endowment is subject to this division and to the Nonprofit Public Benefit Corporation Law (Part 2 (commencing with Section 5110) of Division 2 of Title 1 of the Corporations Code). If there is a conflict between this division and the Nonprofit Public Benefit Corporation Law, this division shall prevail.

Section § 71531

Explanation

This section explains how the California Endowment for Marine Preservation is managed. The Board of Directors overseeing it includes five members: two are government officials from the Natural Resources Agency and Environmental Protection, one is a public appointee by the Governor, one is a marine fisheries expert chosen by the Speaker of the Assembly, and one is from a nonprofit focusing on marine issues, appointed by the Senate Committee on Rules.

The endowment is governed by the Board of Directors of the California Endowment for Marine Preservation, consisting of the following members:
(a)CA Public Resources Code § 71531(a) The Secretary of the Natural Resources Agency.
(b)CA Public Resources Code § 71531(b) The Secretary for Environmental Protection.
(c)CA Public Resources Code § 71531(c) One member of the public appointed by the Governor.
(d)CA Public Resources Code § 71531(d) One member, appointed by the Speaker of the Assembly, who shall be an expert in marine fisheries from the University of California, the California State University, or other accredited university.
(e)CA Public Resources Code § 71531(e) One member, appointed by the Senate Committee on Rules, who shall be from a nonprofit public interest organization with an emphasis on marine conservation or sustainable consumptive recreational activities.

Section § 71532

Explanation

This law section states that board members appointed under certain parts of Section 71531 have a six-year term. However, the first member appointed under one specific part will serve a shorter term of three years.

The term of office of each member of the board appointed pursuant to subdivisions (c) to (e), inclusive, of Section 71531 is six years. However, the term of office for the first board member appointed pursuant to subdivision (c) of Section 71531 is three years.

Section § 71533

Explanation

If there's an empty seat on the board, the person or group who originally appointed the board member gets to choose someone new to fill that spot for the rest of the term.

Any vacancy on the board shall be filled by the appointing authority for the remainder of the unexpired term.

Section § 71534

Explanation

This law section outlines the responsibilities and guidelines for the board's meetings and member attendance. The board must hold its first meeting promptly after it is formed and meet at least twice a year. Board members are required to attend at least half of these meetings annually, or they will lose their position, which will be filled according to another section. Board members do not receive a salary, but some may get $100 per meeting plus travel expenses. The Ocean Protection Council provides staff support for the board's duties.

(a)CA Public Resources Code § 71534(a) The board shall conduct its initial meeting as soon as possible after incorporation.
(b)CA Public Resources Code § 71534(b) The board shall meet as often as required, but at least twice per year.
(c)CA Public Resources Code § 71534(c) Members of the board shall attend at least 50 percent of all duly convened meetings of the board in a calendar year. A member who fails to attend at least 50 percent of all duly convened meetings of the board in a calendar year forfeits membership on the board. The vacancy shall be filled pursuant to Section 71533.
(d)CA Public Resources Code § 71534(d) Members of the board shall receive no salary but members appointed pursuant to subdivisions (c) to (e), inclusive, of Section 71531 shall be paid one hundred dollars ($100) per day for each meeting and shall be reimbursed for all necessary travel expenses.
(e)CA Public Resources Code § 71534(e) The Ocean Protection Council shall provide staff services that the endowment board needs to carry out its duties pursuant to this division.
