Section § 29750

Explanation

The commission must meet at least every two months. These meetings are open to the public, and the schedule must be announced publicly. The details, such as the time and place of meetings, need to be advertised at least once in a major newspaper that covers the delta region. Importantly, meeting notices must be published at least seven days before the meeting date.

Notice of the time and place of all regular and special meetings shall be published at least once in a newspaper of general circulation whose area of circulation is throughout the delta. Section § 29751

Explanation

This section states that more than half of the voting members of the commission need to be present to officially conduct business. For any action to be approved, more than half of the voting members must agree, unless another rule says differently. Also, each member's vote must be recorded separately.

A majority of the voting members of the commission shall constitute a quorum for the transaction of the business of the commission. A majority vote of the voting membership shall be required to take action with respect to any matter unless otherwise specified in this division. The vote of each member shall be individually recorded.

Section § 29752

The commission shall adopt its own rules, regulations, and procedures necessary for its organization and operation, and shall conduct its meetings in compliance with the Bagley-Keene Open Meeting Act (Article 9 (commencing with Section 11120) of Chapter 1 of Part 1 of Division 3 of Title 2 of the Government Code).

Section § 29753

Explanation

This law section mandates that the commission create at least one advisory committee focused on the Delta. These committees should include representatives from state agencies and stakeholders interested in the Delta's ecosystem, water resources, and socioeconomic aspects, like recreation and agriculture. The commission should encourage input from federal agencies like the U.S. Fish and Wildlife Service. (a)CA Public Resources Code § 29753(a) The commission shall appoint at least one advisory committee to provide recommendations regarding the diverse interests within the Delta. At a minimum, the advisory committees shall include representatives of state agencies and other stakeholders with interests in the Delta’s ecosystem, water supply, and socioeconomic sustainability, including, but not limited to, its recreational, agricultural, flood control, environmental, and water resources, and state, local, and utility infrastructure. The commission shall encourage participation of various federal agencies, including the United States Bureau of Reclamation, the United States Fish and Wildlife Service, the United States Army Corps of Engineers, and others as appropriate.
(b)CA Public Resources Code § 29753(b)  The commission may appoint committees from its membership or may appoint additional advisory committees from members of other interested public agencies and private groups.
(c)CA Public Resources Code § 29753(c)  The commission shall seek advice and recommendations from advisory committees appointed by local government that are involved in subject matters affecting the Delta.

Section § 29754

Explanation

This law requires the commission to have an office either in the Delta area or the City of Rio Vista. The commission can rent or buy property and equipment for its office needs. Any records created by the commission that are considered public records must be available for public inspection and copying, following the rules of the California Public Records Act.

The commission shall establish and maintain an office within the Delta or the City of Rio Vista, and for this purpose the commission may rent or own property and equipment. Any rule, regulation, procedure, plan, or other record of the commission that constitutes a public record under state law shall be available for inspection and copying pursuant to the California Public Records Act (Division 10 (commencing with Section 7920.000) of Title 1 of the Government Code).

Section § 29755

Explanation

This section explains that a commission is responsible for hiring and setting the salary for an executive director. The executive director manages the commission's operations and can enter into contracts, following the commission's instructions and policies. With the commission's approval, the executive director can also hire staff needed to carry out the commission’s duties.

The commission shall appoint, and fix the salary of, an executive director who shall have charge of administering the affairs of the commission, including entering into contracts, subject to the directions and policies of the commission. The executive director shall, subject to the approval of the commission, appoint those employees that are necessary to carry out the functions of the commission.

Section § 29756

Explanation

This law section allows the commission to support and manage the process of acquiring voluntary conservation agreements for wildlife and agriculture in the delta area.

The commission may promote, facilitate, and administer the acquisition of voluntary private and public wildlife and agricultural conservation easements in the delta.

Section § 29756.5

Explanation

This law allows the commission to oversee and support joint projects aimed at restoring or improving natural habitats within the main area of the Delta. This can include initiatives like creating a national heritage area in the Delta.

The commission may act as the facilitating agency for the implementation of any joint habitat restoration or enhancement programs located within the primary zone of the Delta, including, but not limited to, a national heritage area designation in the Delta.

Section § 29757

Explanation

This law allows the commission to seek and receive various forms of financial support. It can apply for federal grants, accept donations, and collect rents and royalties. The commission can also use state funds from bond sales, tax proceeds, or other state revenue sources, as well as financial contributions from both public and private entities.

The commission may apply for and accept federal grants or other federal funds and receive gifts, donations, rents, royalties, state funds derived from bond sales, the proceeds of taxes or funds from any other state revenue sources, or any other financial support from public or private sources.

Section § 29758

Explanation

This law states that every member of the commission must follow the rules outlined in Title 9 of the Government Code, starting with Section 85100. These rules generally cover issues like conflicts of interest, financial disclosures, and ethical obligations for public officials.

All members of the commission are subject to Title 9 (commencing with Section 85100) of the Government Code.

Section § 29759

Explanation

The commission must prepare and approve an economic sustainability plan by July 1, 2011. This plan should guide the Delta Stewardship Council on sustaining the Delta region's economy.

Key elements of the plan include recommending ways to improve public safety like flood protection, aligning economic goals with local plans to support agriculture and communities, offering feedback to the Department of Water Resources on flood management updates, and suggesting how to boost recreational activities along river corridors.

(a)CA Public Resources Code § 29759(a) Not later than July 1, 2011, the commission shall prepare and adopt, by a majority vote of the membership of the commission, an economic sustainability plan. The economic sustainability plan shall include information and recommendations that inform the Delta Stewardship Council’s policies regarding the socioeconomic sustainability of the Delta region.
(b)CA Public Resources Code § 29759(b) The economic sustainability plan shall include, but not be limited to, all of the following:
(1)CA Public Resources Code § 29759(b)(1) Public safety recommendations, such as flood protection recommendations.
(2)CA Public Resources Code § 29759(b)(2) The economic goals, policies, and objectives in local general plans and other local economic efforts, including recommendations on continued socioeconomic sustainability of agriculture and its infrastructure and legacy communities in the Delta.
(3)CA Public Resources Code § 29759(b)(3) Comments and recommendations to the Department of Water Resources concerning its periodic update of the flood management plan for the Delta.
(4)CA Public Resources Code § 29759(b)(4) Identification of ways to encourage recreational investment along the key river corridors, as appropriate.
