Section § 21163

Explanation

This section defines a 'No Place Like Home project' as a permanent supportive housing project that is eligible for funding through the No Place Like Home Program. This program is part of the Welfare and Institutions Code, and funding is managed by the Department of Housing and Community Development. A public agency can apply for or receive this funding for such projects.

For purposes of this chapter, “No Place Like Home project” means a permanent supportive housing project that meets the criteria for funding pursuant to the No Place Like Home Program (Part 3.9 (commencing with Section 5849.1) of Division 5 of the Welfare and Institutions Code) and for which a public agency applies for, or receives, funding from the Department of Housing and Community Development.

Section § 21163.1

Explanation

If a public agency decides to seek or is awarded funds from the No Place Like Home Program, this action is not considered a "project" under this specific legal division. This means that certain regulations that apply to projects do not apply here.

A decision by a public agency to seek funding from, or the Department of Housing and Community Development’s awarding of funds pursuant to, the No Place Like Home Program (Part 3.9 (commencing with Section 5849.1) of Division 5 of the Welfare and Institutions Code) does not constitute a “project” for purposes of this division.

Section § 21163.2

Explanation

If you're working on a No Place Like Home project and it doesn't automatically qualify for approval under a specific government code, you can ask for a special review. You have 10 days from when the main agency tells you what kind of environmental paperwork is needed to make this request. This request is for the agency to prepare and certify all documents related to the environmental check, as outlined in another related code.

If a No Place Like Home project is not eligible for approval as a use by right pursuant to Article 11 (commencing with Section 65650) of Chapter 3 of Division 1 of Title 7 of the Government Code and is subject to this division, the development applicant may request, within 10 days after the lead agency determines the type of environmental documentation required for the project pursuant to this division, that the lead agency prepare and certify the record of proceeding for the environmental review of the No Place Like Home project in accordance with Section 21186.

Section § 21163.3

Explanation

This section outlines the procedural requirements for local agencies involved in No Place Like Home projects in California. If a local agency approves or determines to carry out such a project, it must file a notice within two working days, whether the project is subject to the environmental division or not. For projects not subject, a notice of exemption must be filed. If someone wants to challenge the agency's decision based on not following this process, they must do so within 30 days of the notice filing. If the local agency files the notice late, challenges must start within 30 days of the late filing or 90 days from when the notice should have been filed, whichever comes first.

(b)CA Public Resources Code § 21163.3(b) Notwithstanding Section 21167, an action or proceeding to attack, review, set aside, void, or annul the acts or decision of a public agency on the grounds of noncompliance with this division for a No Place Like Home project shall commence within 30 days from the date of the filing of the notice required pursuant to subdivision (a).
(c)CA Public Resources Code § 21163.3(c) If the local agency fails to comply with the applicable timing requirements set forth in subdivision (a), an action or proceeding to attack, review, set aside, void, or annul the acts or decision of a public agency on the grounds of noncompliance with this division for a No Place Like Home project shall commence within 30 days from the date of the local agency’s late filing of the notice required pursuant to subdivision (a) or 90 days from the date that the notice was required to be filed pursuant to subdivision (a), whichever is earlier.

Section § 21163.4

Explanation

This law requires the Department of Housing and Community Development to notify the Speaker of the Assembly and the President pro Tempore of the Senate when all funds from the No Place Like Home Program are completely allocated and disbursed. The notification must be published in the journal of both legislative houses.

The department must also post this notification on its website. The law is set to expire on January 1 following the year the notification is made, at which point it will be repealed.

(2)CA Public Resources Code § 21163.4(a)(2) The Department of Housing and Community Development shall post a copy of the notification provided pursuant to this subdivision on its internet website.
(b)CA Public Resources Code § 21163.4(b) This chapter shall remain in effect only until January 1 of the year following notification from the Department of Housing and Community Development pursuant to subdivision (a), and as of that date is repealed.
