Section § 21163
This section defines a 'No Place Like Home project' as a permanent supportive housing project that is eligible for funding through the No Place Like Home Program. This program is part of the Welfare and Institutions Code, and funding is managed by the Department of Housing and Community Development. A public agency can apply for or receive this funding for such projects.
Section § 21163.1
If a public agency decides to seek or is awarded funds from the No Place Like Home Program, this action is not considered a "project" under this specific legal division. This means that certain regulations that apply to projects do not apply here.
Section § 21163.2
If you're working on a No Place Like Home project and it doesn't automatically qualify for approval under a specific government code, you can ask for a special review. You have 10 days from when the main agency tells you what kind of environmental paperwork is needed to make this request. This request is for the agency to prepare and certify all documents related to the environmental check, as outlined in another related code.
Section § 21163.3
This section outlines the procedural requirements for local agencies involved in No Place Like Home projects in California. If a local agency approves or determines to carry out such a project, it must file a notice within two working days, whether the project is subject to the environmental division or not. For projects not subject, a notice of exemption must be filed. If someone wants to challenge the agency's decision based on not following this process, they must do so within 30 days of the notice filing. If the local agency files the notice late, challenges must start within 30 days of the late filing or 90 days from when the notice should have been filed, whichever comes first.
Section § 21163.4
This law requires the Department of Housing and Community Development to notify the Speaker of the Assembly and the President pro Tempore of the Senate when all funds from the No Place Like Home Program are completely allocated and disbursed. The notification must be published in the journal of both legislative houses.
The department must also post this notification on its website. The law is set to expire on January 1 following the year the notification is made, at which point it will be repealed.
