Section § 19510

Explanation

This law requires that from January 1, 1992, manufacturers must ensure that any fiberglass they make or sell in the state each year includes at least 10% cullet. However, fiberglass that was already in inventory before this date is not subject to this rule.

Except as provided in Section 19511, every manufacturer shall ensure that the annual tonnage of fiberglass manufactured or sold in the state by that manufacturer on and after January 1, 1992, other than fiberglass in inventory manufactured for sale before January 1, 1992, shall contain at least 10 percent cullet .

Section § 19511

Explanation

This law requires fiberglass manufacturers in California to use a certain amount of recycled glass, called cullet, in their production. From January 1, 1994, to December 31, 1994, they must include at least 20% cullet. Starting January 1, 1995, this requirement increases to 30% cullet. However, if using more cullet is too technically difficult or costly compared to its recycling benefits, manufacturers may not have to meet these percentages.

The percentage of fiberglass sold which is made of cullet shall be calculated in tons used on an annual basis. Unless the department determines that an increase in the percentage of cullet would pose an unreasonable technical burden on the fiberglass manufacturer that exceeds the benefits to recycling the cullet, each fiberglass manufacturer shall increase the percentage of cullet in fiberglass in accordance with the following requirements:
(a)CA Public Resources Code § 19511(a) On and after January 1, 1994, until December 31, 1994, the percentage of cullet shall be 20 percent.
(b)CA Public Resources Code § 19511(b) On and after January 1, 1995, the percentage of cullet shall be 30 percent.

Section § 19512

Explanation

This law required the department to consult with fiberglass manufacturers and cullet processors by January 1, 1994, about the possibility of using more cullet, or recycled glass, in fiberglass production to reach a 30% content level. By July 1, 1994, a public hearing was also to be held to discuss and decide on this feasibility with input from industry representatives and other interested parties.

On or before January 1, 1994, the department shall request comments from at least two fiberglass manufacturers, two cullet processors, and any other interested parties on the feasibility of increasing the percentage of cullet in fiberglass to 30 percent. On or before July 1, 1994, the department shall hold a public hearing, on the record, with representatives from the fiberglass industry, cullet processors, and other interested parties to determine the feasibility of increasing cullet content in fiberglass manufacturing.
