Section § 13230

Explanation

This law means that a district is not allowed to run water services facilities in any area of the district that already falls under the jurisdiction of a county water district.

Nothing in this division shall be construed to authorize or permit a district to operate any facilities for furnishing any water services in any portion of the district which is included within a county water district.

Section § 13231

Explanation

This law allows a county water district to choose to set up water service facilities in areas that are part of both the county water district and another district. If they decide to do this, the district has to cover any costs that the county water district doesn't usually pay for.

The county water district may elect to install the facilities for furnishing water services within any area that is included within both districts. In such event, the district shall provide the funds that are required therefor that the county water district would not otherwise provide.

Section § 13232

Explanation

This section explains that if two water districts overlap, one of them can choose to install the water facilities. These installations must follow plans and specifications approved by the county water district and be subject to its inspection and approval.

The county water district may elect to have the facilities installed by the district for providing water services within any area that is included within both districts. In such event, the facilities shall be installed by the district in conformity with plans and specifications previously approved by the county water district, and under such inspection and approval as it shall direct.

Section § 13232.3

Explanation

This section allows the Grizzly Lake, Napa-Berryessa, and Lake Berryessa Resort Improvement Districts to partner with state agencies to finance projects that supply drinking water. The agreements made can last for up to 30 years and must align with the requirements outlined in this division.

The Grizzly Lake Resort Improvement District, the Napa-Berryessa Resort Improvement District, and the Lake Berryessa Resort Improvement District may contract with any state agency to finance any district improvement authorized by this division that is related to the provision of water for human consumption. The terms of the contract shall be consistent with this division. Notwithstanding any other provision in this division, the term of the contract may extend up to 30 years.

Section § 13233

Explanation

This law states that it doesn't take away or reduce any authority that a county water district already has, even if that district overlaps with another district.

Nothing in this division shall be construed to repeal or limit any power possessed by a county water district within which there is any part of this district.
