Section § 25700

Explanation

Under Section 25700, if you carry a handgun illegally according to Section 25400, that handgun is considered a nuisance. This means it can be seized under further legal procedures specified in Sections 18000 and 18005. However, the law has exceptions. It doesn't cover firearms held by the Department of Fish and Game, firearms used in violating fish and game laws, or firearms that are taken away under specific public resources regulations.

(a)CA Penal Law Code § 25700(a) The unlawful carrying of any handgun in violation of Section 25400 is a nuisance and is subject to Sections 18000 and 18005.
(b)CA Penal Law Code § 25700(b) This section does not apply to any of the following:
(1)CA Penal Law Code § 25700(b)(1) Any firearm in the possession of the Department of Fish and Game.
(2)CA Penal Law Code § 25700(b)(2) Any firearm that was used in the violation of any provision of the Fish and Game Code or any regulation adopted pursuant thereto.
(3)CA Penal Law Code § 25700(b)(3) Any firearm that is forfeited pursuant to Section 5008.6 of the Public Resources Code.
